<br />Elk River City Council Minutes <br />April 21, 1992 <br /> <br />Page 4 <br /> <br />. <br /> <br />Peter Beck, City Attorney, reviewed the assessment appeal process. <br />Peter Beck informed the residents that in order to preserve their right <br />to appeal, they must submit a written objection signed by the property <br />owner prior to the conclusion of the assessment hearing. He further <br />indicated that the property owners also have the right to take their <br />appeal to the district court. He stated that in order to preserve this <br />right the property owners must then serve a notice on the City within <br />30 days of the adoption of the assessment roll and file notice with the <br />district court within 10 days after the 30 day time frame. The City <br />Attorney encouraged those people wishing to appeal to submit a signed <br />statement at this time. <br /> <br />Mayor Tralle opened the public hearing. <br /> <br />Yvonne Hetland, 18810 Boston street - Ms. Hetland indicated she had <br />some questions she would like to ask prior to appealing her <br />assessment. She stated her questions revolved around the street <br />portion of the project in front of her home. Terry Maurer, City <br />Engineer, indicated that he would be speaking to the Hetland's <br />regarding closing off this street, however, he was unaware that this <br />matter would be a determining factor as to whether or not they wish to <br />appeal their assessment. He suggested that the Hetland's submit an <br />objection to the assessment at tonight's meeting in order to keep open <br />their right to appeal. <br /> <br />. <br /> <br />Ken Case, 12951 Meadowvale Road - Mr. Case stated that he did not agree <br />with the City's form of assessment on a front footage basis. He stated <br />he would like the City to consider assessing property on a unit basis. <br />He stated that he has a pie shaped lot and the frontage is mostly in <br />front of his home. He indicated that the assessments have been <br />calculated in an unfair manner. He stated he would like the Council to <br />consider assessing the four properties in the Rohlf Addition on a unit <br />basis due to the size of their lots and due to his lot being an unusual <br />shape. <br /> <br />Mr. Case indicated that he would be disappointed if the City's bond <br />rates came in at 8 to 8.5% with the way the market is today. He <br />indicated that he checked with St. Francis who has the same bond rating <br />as Elk River and who has recently sold bonds for a sewer and water <br />project. He stated that their bonds came in a 6.5%. <br /> <br />Mark Davis, 18846 Zumbro - Mr. Davis stated that he was told by staff <br />that he would save approximately $800 if he removed his lot line and <br />combined his two lots. He stated that according to the assessment <br />schedule he received he was not saving any money by removing his lot <br />line and further stated that after reviewing the other lots in the <br />neighborhood, he feels he is being assessed unfairly. <br /> <br />. <br /> <br />Marvin Weaver, 12815 Meadowvale Road - Mr. Weaver stated that he signed <br />a petition in opposition to the project and indicated he did not <br />receive a response to the petition. <br /> <br />Roger Eull, 18880 Boston - Mr. Eull questioned whether the entrances or <br />curb cuts to the extra lots would be provided. <br />
