<br />. <br /> <br />. <br /> <br />. <br /> <br />Elk River City Council Minutes <br />April 20, 1992 <br /> <br />Page 8 <br /> <br />APPROVED BY THE APPROPRIATE STAFF MEMBERS PRIOR TO RECORDING THE <br />VACATION OF THE RIGHTS-OF-WAY FOR 8TH STREET AND INDUSTRIAL ROAD. <br /> <br />2. <br /> <br />THAT CRETEX COMPANIES PREPARE THE QUIT CLAIM DEEDS NECESSARY TO <br />CONVEY THE LAND UNDERLYING THAT PORTION OF 8TH STREET AND <br />INDUSTRIAL ROAD FROM THE CITY TO CRETEX COMPANIES. <br /> <br />3. <br /> <br />THAT THERE IS NOT A GAP BETWEEN QUINN AVENUE AND THE EASEMENT FOR <br />ACCESSING THE WATER TOWER AFTER THE CONVEYANCE OF PROPERTIES FROM <br />THE CITY TO CRETEX. <br /> <br />4. <br /> <br />THAT CRETEX COMPANIES BE ALLOWED TO REMOVE TAR FROM THE FORMER 8TH <br />STREET LOCATION AND GRADE SAID RIGHT-OF-WAY IMMEDIATELY AFTER <br />APPROVAL OF THE CITY COUNCIL FOR THE VACATION, BUT PRIOR TO THE <br />RECORDING OF SAID VACATION. <br /> <br />COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />COUNCILMEMBER DIETZ MOVED TO <br />VACATING PARTS OF MEADOWVALE <br />FOLLOWING STIPULATIONS. <br /> <br />ADOPT <br />ROAD <br /> <br />RESOLUTION 92-25, A RESOLUTION <br />AND 8TH STREET ACCORDING TO THE <br /> <br />1. <br /> <br />THAT CRETEX COMPANY PHYSICALLY SURVEY THE LOCATION OF ALL <br />UTILITIES ON THEIR PROPERTY AND PREPARE APPROPRIATE EASEMENTS TO <br />PROTECT THOSE UTILITIES AND THAT THESE EASEMENTS ARE REVIEWED AND <br />APPROVED BY THE APPROPRIATE STAFF MEMBERS PRIOR TO RECORDING THE <br />VACATION OF THE RIGHTS-OF-WAY FOR 8TH STREET AND INDUSTRIAL ROAD. <br /> <br />2. Conditional Use permit/Rick Foster/Public Hearing <br /> <br />Steve Rohlf explained that Mr. Foster is proposing to develop a 53 acre <br />parcel of property which lies in the northeast corner of the <br />intersection of Highway 169 and 193rd Avenue. <br /> <br />Mayor Tralle opened the public hearing. <br />
