Conditional Use Permit Request by Elk River Municipal Utilities/P.H. <br /> <br />Janelle Szklarski indicated that the Elk River Municipal Utilities is <br />requesting a conditional use permit to construct a new building to <br />house the well and filtration plant which are located at the <br />intersection of Highway 10 and Main Street. She indicated that there <br />is an existing building there which will be removed to accommodate the <br />new structure which will measure 24 feet by 48 feet and will be <br />constructed of concrete panels. Bob Mccartney, representing Elk River <br />utilities, was present. Mary Eberley, Planning Commission <br />Representative, indicated that the Planning Commission recommended <br />approval of the request. <br /> <br />Mayor Tralle opened the public hearing. There being no one for or <br />against the matter, Mayor Tralle closed the public hearing. <br /> <br />COUNCILMEMBER KROPUENSKE MOVED TO APPROVE THE CONDITIONAL USE PERMIT <br />REQUESTED BY ELK RIVER MUNICIPAL UTILITIES TO CONSTRUCT A BUILDING TO <br />HOUSE THE WELL AND FILTRATION PLANT AT THE SITE LOCATED AT HIGHWAY 10 <br />AND MAIN STREET WITH THE FOLLOWING CONDITIONS: <br /> <br />1. THAT A DETAILED GRADING PLAN BE SUBMITTED WITH THE BUILDING PERMIT <br />APPLICATION AND THAT THE SLOPES ARE STABILIZED THROUGH APPROPRIATE <br />METHODS WHICH ARE APPROVED BY THE BUILDING OFFICIAL. <br /> <br />2. <br /> <br />THAT THE PROPOSED PARKING LOT HAVE A BITUMINOUS SURFACE. <br /> <br />3. <br /> <br />THAT THE APPLICANT SHALL AID IN THE IMPLEMENTATION OF <br />LANDSCAPING PLAN AS PREPARED BY THE CITY. <br /> <br />THE <br /> <br />COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />The City Council recessed at 9:05 p.m. and reconvened at 9:15 p.m. <br /> <br />6.8. Ordinance Amendment to Section 900.08 and 900.12 Regulation of Animals <br />by the City of Elk River/P.H. <br /> <br />Janelle Szklarski indicated that City staff is proposing two ordinance <br />amendments to regulate the keeping of animals within the City of Elk <br />River. She noted that this issue was brought to the attention of the <br />City Council when the City received a request to raise ostriches in an <br />agricultural zone. She stated that at that time, the Council referred <br />the animal ordinance to the Planning Commission and the Planning <br />Commission has since then reviewed this ordinance. Janelle stated that <br />the proposed ordinance amendments before the Council regulate domestic, <br />agricultural, dangerous and nontraditional or exotic animals. Mary <br />Eberley stated that the Planning Commission reviewed both ordinance <br />amendments and recommended approval. <br /> <br />Mayor Tralle opened the public hearing.
