Consider Environmental Assessment Worksheet by Barton Sand & Gravel <br /> <br />Steve Rohlf, Building and Zoning Administrator, explained that Barton <br />Sand and Gravel Company is requesting to mine gravel on an approximate <br />75 acre parcel of land located in the southwest corner of the <br />intersection of County Roads 33 and 77. Steve further explained that <br />crushing operations would take place in the new pit area on the west <br />side of Proctor Avenue and then be conveyed under the road to the east <br />side of Proctor Avenue at their current site where washing and <br />transportation would take place. He further indicated that Barton has <br />submitted data to prepare an Environmental Assessment Worksheet which <br />would identify environmental issues for the proposed mine. Steve Rohlf <br />recommended to the Council that an Environmental Impact Statement would <br />not be needed based on responses received from several other <br />governmental agencies and review of the data by City staff. <br /> <br />COUNCILMEMBER KROPUENSKE MOVED TO ADOPT RESOLUTION 92-19, <br />OF NEGATIVE DECLARATION ON ENVIRONMENTAL ASSESSMENT <br />BARTON SAND AND GRAVEL COMPANY. COUNCILMEMBER DIETZ <br />MOTION. THE MOTION CARRIED 5-0. <br /> <br />A RESOLUTION <br />WORKSHEET FOR <br />SECONDED THE <br /> <br />6.2. Consider Zone Change to Mineral Excavation Overlay District by Barton <br />Sand & Gravel Company/p.H. <br /> <br />. <br /> <br />Steve Rohlf explained that Barton Sand and Gravel has applied for a <br />zone change to the Mineral Excavation Overlay District. Mary Eberley, <br />Planning Commission Representative, stated that the Planning Commission <br />reviewed the zone change and recommended approval to the Mineral <br />Excavation Overlay District. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO ADOPT ORDINANCE 92-6, AN ORDINANCE <br />AMENDING THE CITY OF ELK RIVER ZONING MAP TO ZONE CERTAIN PROPERTY TO <br />THE MINERAL EXCAVATION OVERLAY DISTRICT. COUNCILMEMBER HOLMGREN <br />SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />6.3. Consider Conditional Use Permit and License for Mineral Excavation by <br />Barton Sand & Gravel Company/P.H. <br /> <br />Steve Rohlf explained that Barton Sand and Gravel is requesting a <br />conditional use permit for expansion of a gravel pit. Mary Eberley, <br />Planning Commission Representative, indicated that the Planning <br />Commission discussed reclamation issues and the need for a <br />comprehensive plan. She indicated that the Planning Commission <br />recommended approval of the conditional use permit according to the <br />seven standards required by the City. <br /> <br />Mayor Tralle opened the public hearing. There being no one for or <br />against the matter, Mayor Tralle closed the public hearing. <br /> <br />. <br /> <br />The Council discussed the conditions listed in the conditional use <br />permit for Barton Sand and Gravel. Mayor Tralle questioned #8 in the <br />conditional use permit which prohibits the hauling of gravel west on <br />County Road 33. He questioned how this could be enforced.
