He indicated that gravel mining operations currently <br />operating will have grand fathered rights, but the overlay zone will <br />allow the City to control expansion. <br /> <br />Mayor Tralle opened the public hearing. There being no one for or <br />against the matter, Mayor Tralle closed the public hearing. <br /> <br />COUNCILMEMBER KROPUENSKE MOVED TO ADOPT ORDINANCE 92-1, AN ORDINANCE <br />AMENDING CHAPTER 9 OF THE ELK RIVER CITY CODE CREATING A NEW MINERAL <br />EXCAVATION OVERLAY ZONING DISTRICT. COUNCILMEMBER DIETZ SECONDED THE <br />MOTION. THE MOTION CARRIED 5-0. <br /> <br />5.6. Consider Solid Waste Facilities <br /> <br />Steve Rohlf indicated that staff is requesting an ordinance amendment <br />regarding conditional uses allowed in the Solid Waste Facility Overlay <br />District. He indicated that the change is minor as an error was made <br />when the ordinance was originally adopted. The Planning Commission has <br />recommended approval of the ordinance amendment. <br /> <br />Mayor Tralle opened the public hearing. There being no one for or <br />against the public the matter, Mayor Tralle closed the public hearing. <br /> <br />COUNCILMEMBER HOLMGREN MOVED TO ADOPT ORDINANCE 92-02, AN ORDINANCE <br />AMENDING CHAPTER 9 OF THE ELK RIVER CITY CODE TO SPECIFICALLY IDENTIFY <br />CONDITIONAL USES IN THE SOLID WASTE FACILITY SOLID WASTE FACILITY'S <br />OVERLAY DISTRICT. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION <br />CARRIED 4-0. <br /> <br />5.7. NONPROFIT SIGN REQUEST <br /> <br />Steve Rohlf indicated that the Multiple Sclerosis Society has requested <br />to place a banner at the Super America store in Elk River advertising <br />their Super Cities Walk-a-thon from March 9 through AprilS. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO APPROVE THEIR REQUEST TO PLACE A 4 X 8 <br />BANNER AT THE SUPER AMERICA STORE FROM MARCH 9 THROUGH APRIL 5. <br />COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br />Councilmember Kropuenske was away from the Council table. <br /> <br />5.8. Sewer and Water District Map Correction to Comprehensive Plan <br /> <br />Steve Rohlf indicated that staff is requesting an amendment to the <br />Sewer and Water District map. He indicated that a parcel of property <br />located at the southwest corner of the intersection of Main and Highway <br />169 was mistakenly left out of the Sewer and Water District and is <br />requesting to include it within the Sewer and Water District. <br />
