There being no one for or <br />against the matter, Mayor Duitsman closed the public hearing. <br /> <br />COUNCILMEMBER DIETZ MOVED TO ADOPT ORDINANCE 93-3, AN ORDINANCE <br />AMENDING SECTION 900.20, GENERAL REGULATIONS PERTAINING TO ZERO LOT <br />LINES. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED <br />5-0. <br /> <br />6.7.a Staff Interpretation of Iverson Homes Strip Mall <br /> <br />Steve Rohlf, Building and Zoning Administrator, informed the Council <br />that on October 21, 1991, the City Council approved a conditional use <br />permit for a strip mall off of Carson Street, north of Main Street and <br />west of Highway 169. He stated that this strip mall was not <br />constructed and that he has received a new proposal which is comparable <br />with the original conditional use permit. He indicated that the <br />conditional use permit is valid for two years. He stated that staff <br />would request the developer to enter into an agreement which has the <br />same terms and conditions as an original conditional use permit. <br /> <br />The City Council <br />interpretation. <br /> <br />concurred <br /> <br />with <br /> <br />staff's <br /> <br />recommendation <br /> <br />and <br /> <br />6.7.c Raw Land Value Credited for Park Dedication <br /> <br />Steve Rohlf, Building and Zoning Administrator, stated that the <br />developer of Heritage Landing plat has dedicated three quarters of an <br />acre of land to the City to be used for a trail. Steve Rohlf stated <br />that although the land is valued at $3,500 per acre, the trunk <br />assessment per acre is $3,771. He suggested that the Council consider <br />granting a credit to the developer of $5,342 for the three quarter of <br />an acre of land which is being dedicated to the City as a trail. Steve <br />Rohlf indicated that staff does not feel this should be considered a <br />forgiveness of assessments, but that the trunk assessment placed on the <br />land raises the raw land value and therefore a credit should be given <br />to the developers. <br /> <br />Mayor Duitsman stated that he feels the developers should give a <br />certain percentage of the land as park dedication and questioned why <br />the City is granting a payment to the developer. Peter Beck, City <br />Attorney, explained that the City's current system of park dedication <br />is based on the number of units being dedicated. He indicated that in <br />the case of Heritage Landing, the developer will pay $400 per lot being <br />developed and, in this case, the developer is also donating three <br />quarters of an acre. Mayor Duitsman further questioned the $400 per <br />lot and the mixing of the fair market value in payment for dedicated <br />land. <br /> <br />COUNCILMEMBER SCHEEL MOVED TO ACCEPT THE THREE QUARTERS OF AN ACRE OF <br />LAND TO BE DEDICATED TO THE CITY AS A TRAIL FROM THE DEVELOPER OF <br />HERITAGE LANDING WITH A CREDIT OF $5,342 TO BE GIVEN TO THE DEVELOPER <br />FOR THE LAND. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION <br />CARRIED 5-0. <br />
