<br />. <br /> <br />. <br /> <br />. <br /> <br />Elk River City Council Minutes <br />March 15, 1993 <br /> <br />Page 4 <br /> <br />Steve Rohlf stated that Gwen Petersen, 8700 93rd Avenue North, Brooklyn <br />Park, is requesting to subdivide an 80 acre parcel of property into two <br />parcels; a ten acre parcel and a 70 acre parcel. He stated that the <br />parcel of land is located west of County Road 70. steve Rohlf stated <br />that he has a concern regarding the buildability of the lot and <br />suggested that at least one continuous acre of ground must be four feet <br />above the high water table to consider the parcel buildable. <br /> <br />Mayor Duitsman opened the public hearing. <br /> <br />Paula Dargis stated she owns a parcel of land north of the affected <br />property and stated that the field she owns is very wet. She <br />questioned whether building a house on the proposed parcel would cause <br />more water to run into her field. <br /> <br />Gwen Petersen requested that the subdivision be approved subject to the <br />results of the perc test because the financing of the loan is <br />contingent upon the perc test. The Council indicated its concern about <br />approving an administrative subdivision for a lot that may not be <br />buildable. The Council suggested that the applicant provide the <br />results of the perc test prior to the Council prior to approving the <br />administrative subdivision. <br /> <br />COUNCILMEMBER HOLMGREN MOVED TO CONTINUE THIS ISSUE UNTIL THE NEXT <br />COUNCIL MEETING TO BE HELD IN TWO WEEKS. COUNCILMEMBER DIETZ SECONDED <br />THE MOTION. THE MOTION CARRIED 4-0-1. Councilmember Scheel abstained. <br /> <br />6.5. Conditional Use Permit <br />Association/Public Hearing <br /> <br />Request/Sherburne <br /> <br />County <br /> <br />Grower's <br /> <br />Steve Rohlf, Building and Zoning Administrator, indicated that the <br />Sherburne County Grower's Association is requesting a conditional use <br />permit to operate a Farmer's Market downtown in the central commercial <br />zoning district. He stated that the site selected for the Farmer's <br />Market is the City parking lot located between King and Jackson Avenues <br />lying south of Highway 10. <br /> <br />Bill Kennedy, President of the Sherburne County Grower's Association, <br />stated that there may be other locations which the Sherburne County <br />Grower's Association may want to use. He indicated that the <br />Association is looking for approval by the Council with some <br />flexibility. <br /> <br />Mayor Duitsman opened the public hearing. <br /> <br />Jim Mulroy, owner of Snyder Drug, indicated that no problems are <br />anticipated from the downtown merchants. <br /> <br />There being no further comments from the public, Mayor Duitsman closed <br />the public hearing. <br /> <br />COUNCILMEMBER HOLMGREN MOVED <br />REQUEST BY THE SHERBURNE <br /> <br />TO APPROVE THE <br />COUNTY GROWER'S <br /> <br />CONDITIONAL <br />ASSOCIATION <br /> <br />USE PERMIT <br />TO LOCATE A <br />
