<br />City Council Minutes <br />April 21, 1994 <br /> <br />Page 6 <br /> <br />e <br /> <br />Council member Dietz requested the park dedication fees to go directly into the <br />park dedication fund. <br /> <br />COUNCILMEMBER DIETZ MOVED TO APPROVE THE ELK PARK CENTER DEVELOPER'S <br />AGREEMENT INCLUDING THE CHANGES PRESENTED BY THE CITY ATTORNEY. <br />COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />7. Review of Elk Park Center PUD Aareement <br /> <br />The City Attorney reviewed the Planned Unit Development Agreement with the <br />City Council. The City Attorney reviewed several changes to the PUD agreement. <br /> <br />Mayor Duitsman requested public comments on the PUD Agreement. <br /> <br />Lola Driessen thanked the Council for considering the issue of litter. <br /> <br />e <br /> <br />The Council discussed whose responsibility it would be to control the litter along <br />Highway 169 adjacent to the shopping center, within the PUD, and along the <br />Jackson A venue right-of-way. After discussion of this issue, it was the consensus <br />that the PUD Agreement would be amended to include this issue. It was the <br />consensus of the Council that the language would state that the developer be <br />responsible for litter control on property that is developer-owned and along the <br />100 foot easement areas of property owned by the School district and also along <br />the Jackson Avenue right-of-way adjacent to the developer's property. Also, <br />other property owners in the development will be responsible for litter control of <br />their own property and the adjacent right-of-way. <br /> <br />COUNCILMEMBER DIETZ MOVED TO APPROVE THE PUD AGREEMENT FOR ELK PARK <br />CENTER INCLUDING THE AMENDMENTS MADE BY THE CITY ATTORNEY AND THE CITY <br />COUNCIL. COUNCILMEMBER SCHEEL SECONDED THE MOTION. THE MOTION <br />CARRIED 4-0. <br /> <br />8. Review of Elk Park Center Final Plat <br /> <br />City Planner Steve Ach indicated that the final plat for Elk Park Center has been <br />submitted to the City for review and approval. He stated that the final plat has <br />been modified to comply with the conditions for preliminary plat approval. <br /> <br />Mayor Duitsman requested public comment. <br /> <br />Council member Farber questioned the possibility of traffic control at Freeport and <br />Jackson Avenue. He indicated he would like to see a stop sign at Jackson <br />Avenue. City Engineer Terry Maurer suggested monitoring the area and installing <br />a stop sign when it is deemed necessary. <br /> <br />COUNCllMEMBER DIETZ MOVED TO ADOPT RESOLUTION 94-34, A. RESOLUTION <br />GRANTING FINAL PLAT APPROVAL FOR ELK PARK CENTER. COUNCILMEMBER FARBER <br />SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />e <br />
