<br />City Council Minutes <br />April 21, 1994 <br /> <br />Page 5 <br /> <br />e <br /> <br />City Administrator, Pat Klaers informed the Council that the city flag has been <br />completed and will be presented to Rick Johnson, the designer of the flag, on <br />May 2,1994. <br /> <br />The City Administrator requested authorization to attend the 1994 national <br />conference. <br /> <br />COUNCILMEMBER DIETZ MOVED TO AUTHORIZE THE CITY ADMINISTRATOR TO <br />ATTEND THE CITY ADMINISTRATOR NATIONAL CONFERENCE. COUNCILMEMBER <br />FARBER SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />COUNCILMEMBER DIETZ MOVED TO SEND A lETTER OF COMMENDATION TO THE FIRE <br />DEPARTMENT FOR THEIR EXCELLENT RESPONSE TIME TO THE RDF FIRE. <br />COUNCILMEMBER SCHEEL SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />The Council recessed at 6:25 p.m. The Council reconvened at 7:00 p.m. <br /> <br />5. <br /> <br />Elk Park Center and Northeast area trunk sanitary sewer and water improvements <br />IPublic Hearing <br /> <br />e <br /> <br />City Engineer, Terry Maurer, informed the Council that the. public hearing <br />scheduled for this evening is to consider trunk sanitary sewer and water <br />improvements to serve Elk Park Center, Oak Parc Estates and Hillside Estates. In <br />addition, the School District property between School Street and the south plat <br />line of Elk Park Center will be served by these improvements. <br />j <br /> <br />Mayor Duitsman opened the public hearing. There being' no one for or against <br />the matter, Mayor Duitsman closed the pubic hearing. <br /> <br />COUNCILMEMBER DIETZ MOVED TO ADOPT RESOLUTION 94-33, A RESOLUTION <br />ORDERING THE IMPROVEMENT IN THE MATTER OF THE NORTHEAST (ELK PARK CENTER) <br />AREA TRUNK SANITARY SEWER AND WATER IMPROVEMENT OF 1994. <br />COUNCllMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />6. Review of Elk Park Center Developer's Aareement <br /> <br />City Attorney Peter Beck reviewed the draft developer's agreement for Elk Park <br />Center. He indicated that there are a number of changes to the draft. Peter <br />Beck reviewed each change with the City Council. He summarized the purpose <br />of the developer's agreement which is to provide for the installation and <br />payment for public utilities and improvements that will serve the project. <br /> <br />Mayor Duitsman requested public comments. <br /> <br />The City Council received a list of concerns regarding the developer's agreement <br />from Rolfe Anderson. The Council reviewed each of these concerns. <br /> <br />e <br /> <br />The developers requested that the street lighting be compatible with the lighting <br />in the shopping center. It was the consensus of the Council to have the <br />developers work together with Elk River Utilities regarding street lights. <br />
