City Council Minutes April 21, 1994 Page 5 e City Administrator, Pat Klaers informed the Council that the city flag has been completed and will be presented to Rick Johnson, the designer of the flag, on May 2,1994. The City Administrator requested authorization to attend the 1994 national conference. COUNCILMEMBER DIETZ MOVED TO AUTHORIZE THE CITY ADMINISTRATOR TO ATTEND THE CITY ADMINISTRATOR NATIONAL CONFERENCE. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 4-0. COUNCILMEMBER DIETZ MOVED TO SEND A lETTER OF COMMENDATION TO THE FIRE DEPARTMENT FOR THEIR EXCELLENT RESPONSE TIME TO THE RDF FIRE. COUNCILMEMBER SCHEEL SECONDED THE MOTION. THE MOTION CARRIED 4-0. The Council recessed at 6:25 p.m. The Council reconvened at 7:00 p.m. 5. Elk Park Center and Northeast area trunk sanitary sewer and water improvements IPublic Hearing e City Engineer, Terry Maurer, informed the Council that the. public hearing scheduled for this evening is to consider trunk sanitary sewer and water improvements to serve Elk Park Center, Oak Parc Estates and Hillside Estates. In addition, the School District property between School Street and the south plat line of Elk Park Center will be served by these improvements. j Mayor Duitsman opened the public hearing. There being' no one for or against the matter, Mayor Duitsman closed the pubic hearing. COUNCILMEMBER DIETZ MOVED TO ADOPT RESOLUTION 94-33, A RESOLUTION ORDERING THE IMPROVEMENT IN THE MATTER OF THE NORTHEAST (ELK PARK CENTER) AREA TRUNK SANITARY SEWER AND WATER IMPROVEMENT OF 1994. COUNCllMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 4-0. 6. Review of Elk Park Center Developer's Aareement City Attorney Peter Beck reviewed the draft developer's agreement for Elk Park Center. He indicated that there are a number of changes to the draft. Peter Beck reviewed each change with the City Council. He summarized the purpose of the developer's agreement which is to provide for the installation and payment for public utilities and improvements that will serve the project. Mayor Duitsman requested public comments. The City Council received a list of concerns regarding the developer's agreement from Rolfe Anderson. The Council reviewed each of these concerns. e The developers requested that the street lighting be compatible with the lighting in the shopping center. It was the consensus of the Council to have the developers work together with Elk River Utilities regarding street lights.
