Upon recording of the new legal. the garage currently located on the <br />property may only be used by the adjoining residence at 406 Main St. for <br />non-commercial use. <br /> <br />3. The 1994 taxes be paid in full prior to recording the new subdivision. <br /> <br />The Council discussed these options. It was the consensus that an opinion from <br />the attorney was necessary to determine if the garage could stay on a parcel by <br />itself. Council member Dietz indicated he was not in favor of allowing a storage <br />building on a lot as the primary structure. Councilmember Scheel indicated that <br />she had no problem with the storage building being located on the lot by itself. <br /> <br />COUNCILMEMBER SCHEEL MOVED TO CONTINUE THIS ITEM TO THE MAY 16 COUNCIL <br />MEETING, UNTIL THE CITY RECEIVED A LEGAL OPINION ON THE ISSUE OF THE <br />STORAGE BUILDING. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE <br />MOTION CARRIED 4-0. <br /> <br />6.8. <br /> <br />Consider Reauest for Preliminary Plat (Elk Park Center 2nd Addition) by Kraus- <br />Anderson of Elk River, Inc.JPublic Hearina AS 94-7 <br /> <br />e <br /> <br />Gary Schmitz indicated that Kraus-Anderson has requested to plat two lots which <br />will be known as Elk Park Center 2nd Addition. The two lots are exceptions from <br />the Elk Park Center 1 st Addition and are known as Lot 1, Block 1 and Outlot A. Lot <br />1. block 1 is the balance of Mr. Dickenson's property which has not been <br />included as part of Elk Park Center's shopping center. Outlot A is the location <br />where the 4 single family homes currently exist that will be purchased by Kraus- <br />Anderson and made part of the storm drainage pond to serve the Elk Park Center <br />Project. <br /> <br />Vice Mayor Farber opened the public hearing. There being no one for or against <br />the matter, Vice Mayor Farber closed the public hearing. <br /> <br />COUNCILMEMBER DIETZ MOVED TO APPROVE THE PRELIMINARY PLAT FOR ELK PARK <br />CENTER 2ND ADDITION WITH THE FOLLOWING CONDITIONS: <br /> <br />1. OUTLOT A INCLUDE A DRAINAGE AND UTILITY EASEMENT OVER THE ENTIRE <br />LOT TO COINCIDE WITH THE STORM DRAINAGE POND. <br /> <br />2. TRUNK SANITARY SEWER AND WATER CHARGE IN THE AMOUNT OF $3,800 PER <br />ACRE BE PAID FOR LOT 1, BLOCK 1, PRIOR TO RELEASING THE PLAT FOR <br />RECORDING. <br /> <br />3. ALL HOMES WITHIN OUTLOT A SHALL BE REMOVED FROM THE PROPERTY <br />WITHIN THREE MONTHS FROM THE DATE OF COUNCIL ACTION. <br /> <br />4. FUTURE DEVELOPMENT OF LOT 1, BLOCK 1, BE COMPATIBLE WITH ALL DESIGN <br />AND APPLICABLE STANDARDS FOR ELK PARK CENTER. <br /> <br />e <br /> <br />5. <br /> <br />APPROPRIATE DRAINAGE AND UTILITY EASEMENTS BE INCLUDED ON THE PLAT <br />AS REQUIRED BY THE CITY. <br />
