<br />City Council Minutes <br />April 18, 1994 <br /> <br />Page 6 <br /> <br />e <br /> <br />15. <br /> <br />AT STAFF'S DISCRETION, COMMERCIAL ASPHALT IMPLEMENT PART OR ALL OF <br />THE ACTIONS IDENTIFIED BY STAFF TO ELIMINATE SEDIMENT FROM BEING <br />INTRODUCED TO THE POND ON THE EAST SIDE OF HIGHWAY 169. <br /> <br />16. COMMERCIAL ASPHALT SHALL REDUCE ODOR FROM THEIR PLANT TO <br />ACCEPTABLE LEVELS BY MODIFYING THEIR OPERATIONAL PROCEDURES OR <br />PLANT EQUIPMENT. THE ELK RIVER PLANNING COMMISSION WILL REVIEW THE <br />ODOR ISSUE AGAIN IN JUNE OF 1994. <br /> <br />COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />6.5. Administrative Subdivision Reauest bv Arlon Molde/Public Hearina - AS-94-06 <br /> <br />Gary Schmitz indicated that Arlon Molde is requesting an administrative <br />subdivision to divide a 10.8 acre parcel into a 7.2 acre parcel and a 3.6 acre <br />parcel. Both lots would have frontage on County Road No. 1 and are located <br />west of County Road No.1, just north of Woodland Trails Park. <br /> <br />Vice Mayor Farber opened the public hearing. There being no one for or against <br />the matter. Vice Mayor Farber closed the public hearing. <br /> <br />COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE ADMINISTRATIVE <br />SUBDIVISION REQUEST BY ARLON MOLDE TO DIVIDE 10.8 ACRES INTO ONE 7.2 ACRE <br />PARCEL AND ONE 3.6 ACRE PARCEL WITH THE FOLLOWING STIPULATIONS: <br /> <br />e <br /> <br />1. <br /> <br />PAYMENT OF PARK DEDICATION FEES IN THE AMOUNT OF $450 BE PAID TO <br />THE CITY PRIOR TO RECORDING. <br /> <br />2. A TREE PROTECTION PLAN BE IMPLEMENTED AT THE TIME OF BUILDING PERMIT <br />APPLICATION. <br /> <br />3. PRIOR TO RECORDING, THE APPLICANT MUST SHOW THAT THE EXISTING <br />HOME MEETS ALL R1 A SETBACK REQUIREMENTS. <br /> <br />COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />6.6 & 6.7. Administrative Subdivision and Conditional Use Permit reauest by James <br />Rossman/public hearina - AS 94-03 and CU94-06 <br /> <br />Gary Schmitz stated that James Rossman is requesting a conditional use permit <br />for a zero lot line development (shared driveway) and an administrative <br />subdivision to divide Mr. Rossman's existing parcel into two parcels. Gary Schmitz <br />indicated that the existing detached garage would have to be moved on the <br />parcel containing the house, if the lot were subdivided. <br /> <br />Vice Mayor Farber opened the public hearing. <br /> <br />e <br /> <br />Jim Rossman, owner of the property, read a letter from himself, addressed to the <br />City Council. Mr. Rossman indicated that he does not intend to limit the future <br />development of the new lots to only the concept of a shared driveway, which is <br />requested by the City. Mr. Rossman requested approval of his request with the <br />following conditions: <br />
