<br />Elk River City Council Minutes <br />November 15, 1999 <br /> <br />Page 3 <br /> <br />e <br /> <br />6.2. <br /> <br />Request by City of Elk River for Ordinance Amendment to Allow Liquor Stores Selling <br />Packaaed Goods as a Conditional Use in the C3, Hiahway Commercial District, <br />Public Hearing Case No. OA 99-15 <br /> <br />Director of Planning Michele McPherson indicated that the city is requesting that <br />the C3, Highway Commercial District be amended to allow off sale liquor stores as <br />a conditional use. She noted that the Planning Commission reviewed this request <br />and recommended approval. She further indicated that a public hearing has <br />been conducted and that no testimony was received at the public hearing. <br /> <br />Following council discussion it was the consensus that it was not necessary to act <br />on this request at this time. <br /> <br />COUNCILMEMBER MOTIN MOVED TO POSTPONE THIS REQUEST INDEFINITELY. <br />COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />6.3. <br /> <br />Request by City of Elk River for Ordinance Amendment to Allow Clustered <br />Subdivisions in the R1 a and A 1 Zonina Districts, Public Hearinq Case No. OA 98-3 <br /> <br />e <br /> <br />City Planner Steve Wensman stated that the City of Elk River is requesting an <br />ordinance amendment to allow single family residential cluster development in the <br />Rl a and A 1 zoning districts as a permitted use. Steve Wensman indicated that the <br />City Council held a public hearing on this issue on October 26 and requested staff <br />to incorporate revisions to the ordinance that were requested by the council. <br />Steve Wensman reviewed the revisions that were included in the ordinance. <br /> <br />Mayor Klinzing opened the public hearing. <br /> <br />Dick Gruys, 22347 Monroe Street, talked about his concerns with enforcing the <br />cluster ordinance relating to absentee homeowners and people filing bankruptcy. <br /> <br />There being no further comments, Mayor Klinzing closed the public hearing. <br /> <br />MAYOR KLINZING MOVED TO ADOPT ORDINANCE 99-32 AMENDING SECTION 900.08, <br />900,12, AND 1008.20 OF THE CITY CODE OF ORDINANCES ESTABLISHING OPEN SPACE <br />PRESERVATION PLATS AS A PERMITTED USE IN THE RI1 AND A 1 ZONING DISTRICTS AND <br />ESTABLISHING STANDARDS FOR THEIR CREATION, CASE NO. OA 98-3. <br />COUNCILMEMBER MOTlN SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />7.1. Consider Resolution in Support of County Road 12 Improvements <br /> <br />City Engineer Terry Maurer indicated that in order to move ahead with the County <br />Road 12 improvements, the city must enter into a cooperative agreement with <br />Sherburne County for the reconstruction of County State Aid Highway 12. Terry <br />Maurer noted that the city's share of the construction cost should be between <br />$150,000-$200,000. Discussion was held regarding the county cost sharing policy. <br /> <br />e <br /> <br />COUNCILMEMBER THOMPSON MOVED TO ADOPT RESOLUTION 99-86 ENTERING INTO <br />A COOPERATIVE AGREEMENT WITH SHERBURNE COUNTY FOR THE RECONSTRUCTION <br />OF COUNTY STATE AID HIGHWAY 12. COUNCILMEMBER DIETZ SECONDED THE <br />MOTION. THE MOTION CARRIED 4-0. <br />
