Overall, the Commission concurred with staffs recommendations. <br />Planning Commission recommended that the Council approve the Preliminary Plat <br />sighting staffs memorandum, with the following additional conditions: <br /> <br />. THAT PRIOR TO PRELIMINARY PLAT APPROVAL, THE DEVELOPER SHALL <br />INVENTORY THE TREES ON THE WESTERN BORDER OF LOT 1, BLOCK 1, <br />ILLISTRATE THE TREES ON THE GRADING PLAN AND MAKE THE <br />NECESSARY REVISIONS TO THE GRADING PLAN TO PROTECT THOSE <br />TREES. PRIOR TO GRADING, THE DEVELOPER SHALL VISUALLY SHOW THE <br />LINE BEYOND WHICH GRADING SHALL NOT OCCUR AND SHALL TAKE ALL <br />NECESSARY PRECAUTIONS FOR EROSION CONTROL AND TO PREVENT <br />DAMAGE TO THE TREES. <br /> <br />. THE SIDE YARD SETBACK FOR THE WEST SIDE OF LOT 1, BLOCK 1 SHALL <br />BE 20 FEET. <br /> <br />An additional condition to consider in respect to tree preservation is as follows: <br /> <br />. THAT ANY TREES ON OR OFF SITE, NEAR THE LIMIT OF GRADING THAT <br />ARE TO BE PROTECTED SHALL BE FENCED AT THE DRIPLINE TO PREVENT <br />GRADING, COMPACTION, OR STORAGE OF DEBRIS OR EQUIPMENT. <br /> <br />At the September 20, 1999 City Council meeting, this item was postponed so that <br />the developer could comply with the additional Planning Commission conditions <br />(See attached revisions). <br /> <br />Recommendation <br /> <br />Staff and the Planning Commission recommend that the City Council approve the <br />Preliminary Plat for an 86 lot single-family residential development with the <br />following conditions: <br /> <br />1. THAT A DEVELOPERS AGREEMENT BE PREPARED OUTLINING THE <br />TERMS AND CONDITIONS OF THE PLAT APPROVAL, INSTALLATION OF <br />IMPROVEMENTS AND RECORDED WITH THE FINAL PLAT. <br /> <br />2. THAT ALL COMMENTS OF THE CITY ENGINEER'S BE ADDRESSED. <br /> <br />3. THAT THE DEVELOPER OPTAIN ALL THE APPLICABLE PERMITS PRIOR TO <br />FILLING ANY WETLANDS. <br /> <br />4. THAT A RESTRICTIVE COVENANT AND DRAINAGE AND UTILITY <br />EASEMENT BE RECORDED ON THE MITIGATION AREAS. <br /> <br />5. THAT THE DEVELOPER'S AGREEMENT FOR THE PROJECT INCLUDE <br />LANGUAGE THAT PLACES THE RESPONSIBILITY FOR THE SUCCESS OF <br />THE WETLAND MITIGATION ON THE DEVELOPER. <br /> <br />\ \elkriver\sys\shrdoc\planning\stevewen \ccmmo \p99-9.doc <br />
