THAT THE LETTER OF CREDIT COVERING THE PUBLIC IMPROVEMENTS <br />ASSOCIATED WITH THE PROJECT ALSO INCLUDE THE COST OF THE <br />MITIGATION WORK. <br /> <br />7. THAT THE DEVELOPER SUBMIT A WRITTEN MONITERING REPORT ON <br />THE REPLACEMENT WETLANDS ONE YEAR AFTER THIS MITIGATIO WORK <br />IS COMPLETED AND THAT THIS REPORT BE APPROVED BY THE CITY <br />STAFF PRIOR TO RELEASING OF THE LETTER OF CREDIT. <br /> <br />8. THAT SNOW STORAGE EASEMENTS BE PROVIDED IN THE CUL-DE-SACS <br /> <br />9. THAT A HOMEOWNERS ASSOCIATION DOCUMENT BE PREPARED THAT <br />HOLDS THE ASSOCIATION RESPONSIBLE FOR MAINTENANCE OF THE <br />RETAINING WALLS AND LANDSCAPING ON PUBLIC PROPERTY AND THE <br />FOUNTAIN ASSOCIATED WITH THE NURP POND, SUBJECT TO THE CITY <br />ATTORNEY REVIEW AND APPROVAL, PRIOR TO FINAL PLAT. <br /> <br />10. THAT A PERMIT FOR A ROAD ACCESS ONTO COUNTY ROAD NO.1 BE <br />OBTAINED FROM SHERBURNE COUNTY PRIOR TO FINAL PLAT. <br /> <br />11. THAT THE DOUBLE FRONTED LOTS ALONG BE SCREENED FROM COUNTY <br />ROAD NO.1 AND THAT A LANDSCAPE EASEMENT BE RECORDED WITH <br />THE COUNTY AGAINST THESE LOTS WITH THE RECORDING OF THE FINAL <br />PLAT. <br /> <br />. <br /> <br />12. THAT STREET LIGHTS BE INSTALLED AS REQUIRED BY ELK RIVER <br />UTILITIES. <br /> <br />13. THAT A LETTER OF CREDIT BE PROVIDED TO THE CITY IN THE AMOUNT <br />OF 100% OF THE COSTS OF PUBLIC IMPROVEMENTS. <br /> <br />14. THAT THE BITUMINOUS PARK TRAIL BE INSTALLED IN THE FIRST PHASE <br />WITH THE PUBLIC IMPROVEMENTS. <br /> <br />15. THAT A SIDEWALK BE INSTALLED ON SOUTH SIDE OF THE MAIN EAST <br />WEST ROAD IN THE DEVELOPMENT. <br /> <br />16. THAT UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING <br />THEM ACCEPTED BY THE CITY, A WARRANTY BOND IN THE AMOUNT OF 25 <br />% OF THE IMPROVEMENT COSTS SHALL BE SUBMITTED TO THE CITY FOR <br />A ONE-YEAR PERIOD. <br /> <br />17. THAT A SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED <br />BY THE CITY AT THE TIME OF FINAL PLAT BE PAID PRIOR TO RELEASING <br />THE PLAT FOR RECORDING WITH SHERBURNE COUNTY. <br /> <br />18.
