2. Coverage terms <br /> Cities or joint powers entities that choose the LMCIT airport coverage option <br /> are provided coverage under the city's existing LMCIT liability coverage <br /> document. It is provided under an endorsement that modifies the"airport" <br /> exclusion in the basic municipal liability coverage document. <br /> Since the airport liability exposure is wrapped under the basic LMCIT liability <br /> coverage document, the coverage for liability related to airport operations is <br /> extremely broad. It is specifically designed to address several important <br /> airport exposures, including: <br /> • Damage to an aircraft that's in the city's care, custody, and control or what <br /> is commonly referred to as"hangarkeeper's liability." <br /> • Products liability coverage for city fueling operations. <br /> • Claims relating to noise, vibration, and so on. <br /> • Exposures related to errors and omissions such as employment liability <br /> and liability for damages other than bodily injury, personal injury or <br /> property damage (the errors and omissions risk is covered under the city's <br /> existing LMCIT liability coverage). <br /> There are only a few specific airport-related exclusions to be aware of, <br /> including: <br /> • Any aircraft exhibitions,racing, stunting, aerobatics, skydiving or similar <br /> activities the city sponsors or participates in. <br /> • Liability relating to any fixed based operator activities such as aircraft <br /> service,maintenance, or repair which the city performs (there is an <br /> exception related to fueling operations by the city). <br /> • Liability relating to any aircraft products the city sells. <br /> • Liability for damage to an aircraft that's in the city's care, custody, and <br /> control while the aircraft is in flight. <br /> • Liability arising from operation of an aircraft by the city is generally <br /> excluded, although there is an exception for situations where the city <br /> might"operate" someone else's aircraft simply for the purpose of moving <br /> it around on the airport premises. If a city employee flies airplanes on city <br /> business, separate liability coverage is needed. <br /> An independent contractor is not a covered party under the city's coverage.
