the definitions of "Mortgage" and "Mortgagee" in the Lease to mean the documents <br />evidencing the new indebtedness and the holder of such indebtedness, respectively, and, in the <br />case of the Mortgage, to refer to sections therein); but shall execute and deliver a subordination <br />and attornment agreement to any lender and to Landlord if such lender and Landlord shall in turn <br />deliver a nondisturbance agreement to Tenant, in each case on commercially reasonable terms <br />and consistent with the provisions of this Article 15. <br />ARTICLE 16 <br />SIGNS AND BUILDING IDENTIFICATION <br />16.1 Stens. Tenant may erect any signs on the exterior or interior of the Building or <br />elsewhere on the Premises, provided that such sign or signs (i) do not cause any structural <br />damage to the Building; (ii) have been approved by Landlord, such approval not to be <br />unreasonably withheld, conditioned or delayed, and (iii) do not violate Applicable Laws. <br />Landlord shall have no right to install, construct or place any signs on any portion of the <br />Premises; provided, however, that Landlord may place commercially reasonable "for sale" or <br />"for rent" signs on the Premises during the last six (6) months of the Term, so long as such signs <br />comply with Applicable Laws. On the Expiration Date, Tenant will, at Tenant's sole cost, <br />remove all of its signs from the Premises. Tenant shall repair any damage to the Premises caused <br />by removal of the signs, and restore the portion of the Premises affected by the removal of the <br />signs to a condition required by Landlord. <br />16.2 Premises Designations. From and after the date hereof until the designation <br />provisions of this Article are terminated as provided below, Landlord shall identify the Building <br />and the Premises as reasonably required by Tenant from time to time. Said identifications are <br />referred to herein as the "Tenant Designations". If an Event of Default exists, then Tenant shall <br />have no right to new Tenant Designations. In the event of any claim by any third party against <br />the Landlord of infringement or similar improper use of the Tenant Designations, Tenant shall <br />indemnify, defend and hold the Landlord, harmless from and against any and all such claims <br />(except to the extent arising out of the negligence or willful misconduct of the Landlord). <br />Nothing herein shall require the Landlord to incur any expense or obligation in identifying the <br />Building and the Premises, and such expenses and obligations shall be the responsibility of <br />Tenant. <br />16.3 Discontinuance of Designations. Tenant may at any time during or after the Term <br />for any reason within its sole discretion require Landlord to discontinue the Tenant Designations <br />by giving written notice to Landlord requiring discontinuance of the Tenant Designations as of a <br />specified date, which date may not be less than ninety (90) days after the date of Tenant's notice. <br />16.4 Tenant Trade Name. Landlord acknowledges that no ownership or similar <br />interest, whether legal, beneficial or equitable, has been transferred to it with respect to the name <br />"Sportech, Inc.", the Tenant Designations, or any variations thereof. <br />27 <br />
