<br />City Council Minutes <br />September 7, 2004 <br /> <br />Page 8 <br /> <br />_______________~__M__________ <br /> <br />Ms. Johnson indicated that the new policy for Workers' Compensation beginning <br />October 1, 2004 has been received. She stated that it shows an experience modification of <br />.81, is slightly up from last year's modification factor of .78. She stated that the safety <br />program has played an important role in reducing workplace injuries. Ms. Johnson explained <br />that based on claims experience, it is recommended that the city remain with the $10,000.00 <br />deductible. <br /> <br />MOVED BY COUNCILMEMBER DIETZ AND SECONDED BY <br />COUNCILMEMBER KUESTER FOR APPROVAL OF THE WORKERS' <br />COMPENSATION POLICY RENEWAL WITH THE LEAGUE OF <br />MINNESOTA CITIES INSURANCE TRUST, INCLUDING MANAGED CARE <br />AND A $10,000.00 DEDUCTIBLE. MOTION CARRIED 4-0. <br /> <br />5.9. Consider 2004 Overlay Proiect Supplemental Hearings <br /> <br />City Engineer Terry Maurer indicated that the property at 11769 Brentwood Lane in <br />Brentwood Addition changed ownership as of February 26, 2004. Mr. Maurer stated that <br />when staff compiled the mailing list for the recently completed 2004 Overlay Public Hearing <br />and Assessment Hearing in April 2004, the county records did not reflect the new owners. <br />The notices of the public hearing were mailed out a few weeks later, by which time the <br />county records had been changed to reflect the new owners but city staff did not catch the <br />change and therefore, the previous owners were notified of the hearings. Mr. Maurer stated <br />that this situation has been discussed with City Attorney Peter Beck and the conclusion is <br />that a Supplemental Public Hearing/Assessment Hearing should be held for the new <br />owners, Mark and Donna Mengelkoch. He indicated that the Supplemental <br />Hearing/Assessment Hearing is scheduled for October 18, 2004. <br /> <br />Mr. Maurer stated that he met with Mr. Mengelkoch and explained the situation and offered <br />an opportunity to sign a Waiver and Agreement for Assessment. 11r. Maurer indicated that <br />he advised Mr. Mengelkoch to discuss the situation with his wife and get back to staff. He <br />noted that if the Mengelkoch's sign the Waiver, the need for a Supplemental hearing will no <br />longer exist. <br /> <br />Acting Mayor Motin questioned how long staff would wait to hear from the Mengelkoch's <br />before publishing the Public Hearing/Assessment Hearing notices in the paper as to not <br />incur unnecessary costs. Mr. Maurer indicated that the October 18 hearing date was chosen <br />to allow ample time to discuss the situation with the Mengelkochs and for publishing. <br /> <br />MOVED BY COUNCILMEMBER KUESTER AND SECONDED BY <br />COUNCILMEMBER TVEITE TO APPROVE THE FOLLOWING <br />RESOLUTIONS: <br /> <br />. RESOLUTION 04-68 RECEIVING THE FEASIBILITY REPORT AND <br />ORDERING A SUPPLEMENTAL PUBLIC HEARING ON THE <br />IMPROVEMENT IN THE MATTER OF THE BITUMINIOUS OVERLAY <br />IMPROVEMENT OF 2004. <br /> <br />. RESOLUTION 04-69 DETERMINING ASSESSED COST OF <br />IMPROVEMENT AND ORDERING PREPARATION OF PROPOSED <br />SUPPLEMENTAL ASSESSMENT ROLL IN THE MATTER OF THE <br />BITUMINIOUS OVERLAY IMPROVEMENT OF 2004. <br />
