MnDOT Agreement No. 78569 <br />AMENDMENT No. 1 to MnDOT AGREEMENT No. 78569 <br /> <br />'I'his Amendment is by and between the State of Minnesota, through its Commissioner of Transportation <br />("STATE") and Northstar Corridor Development Authority ("GRANTEE"). <br /> <br />Recitals <br /> <br />1.STATE has a Grant Contract with GRANTEE, identified as MnDOT Agreement No. 78569, to complete <br /> · studies for the proposed commuter rail project in the Northstar Corridor, to undertake a public <br /> information and involvement program, to negotiate with Burlington Northern Santa Fe, and to perform <br /> other components of the GRANTEE's Work Plan, which was attached and incorporated into the Original <br /> Grant Contract as Exhibit I. <br /> <br />2.In early 2000, GRANTEE received approval from the Federal Transit Administration to begin preliminary <br /> engineering on the Northstar Corridor project. <br /> <br />o <br /> <br />Effective August 1, 1999, all work under the Original Grant Contract and all Amendments to it are subject <br />to Laws of Minnesota for 2000, Chapter 230, Sections 19 to 24, codified in Minnesota Statutes, Sections <br />174.80 to 174.90, including any agreement that may be entered into under this law. <br /> <br />4. STATE and GRANTEE have agreed that STATE will receive up to $450,000.00 from GRANTEE's <br /> Original Grant Contract amount as a Management Fee for the Northstar Commuter Rail Project. <br /> <br />STATE and GRANTEE agree to amend the Original Grant Contract to add Preliminary Engineering to <br />GRANTEE's duties as work to be performed under the Grant Contract, to provide that the Original Grant <br />Contract and any Amendments to it are subject to Minnesota Statutes, Sections 174.80 to 174.90, and to <br />ensure that GRANTEE's graphics and engineering drawings will be provided in a format that is compatible <br />with STATE's graphics software program. <br /> <br />Contract Amendment <br /> <br />REVISION 1. In Article II. GRANTEE's DUTIES, paragraph E, after the last sentence, insert: <br /> <br />"All graphics and engineering drawings prepared by GRANTEE must be provided to STATE in <br />MicroStation format." <br /> <br />REVISION 2. In Article II. GRANTEE's DUTIES, after paragraph E., insert: <br /> <br /> "F. Complete preliminary engineering of: <br /> 1. improvements to the BNSF railroad as needed to provide for commuter rail service; <br /> and <br /> 2. other required commuter rail system components. <br />Details of GRANTEE's Work Program for Preliminary Engineering are attached and incorporated <br />into this Grant Contract as Exhibit II. <br /> <br />Word - Amendment form Rev.
