THE MOTION CARRIED 4-0. <br /> <br />6.7. <br /> <br />Request by Richard Kincanon for Easement Vacation, Public Hearinq Case No. <br />EV 98-4 <br /> <br />Staff report by Steve Wensman, Planner. Richard Kincanon is requesting the <br />vacation of a drainage and utility easement on Lot 7, Block 1, of Heritage <br />Landing 2nd Addition. At the time of platting, an extra large drainage and utility <br />easement was created because the drainage issues were not known. The <br />applicant feels the large easement is no longer necessary now that the drainage <br />patterns have been identified. The applicant states that he has been unable to <br />sell the lot because of strong objections by potential buyers to the size of the <br />easement. Staff recommends approval of the request with the condition stated <br />in the staff report. <br /> <br />Mayor Duitsman opened the public hearing. <br /> <br />Dennis Chuba, partner to applicant, discussed the reasons for his request, as <br />presented by staff. <br /> <br />There being no other public comments, Mayor Duitsman closed the public <br />hearing. <br /> <br />COUNCILMEMBER DIETZ MOVED APPROVAL OF RESOLUTION NO.98-67, VACATING <br />THE DRAINAGE AND UTILITY EASEMENT AS SHOWN ON LOT 7, BLOCK 1, HERITAGE <br />LANDING SECOND ADDITION WITH THE FOLLOWING CONDITION: <br /> <br />THAT A LICENSED SURVEYOR PROVIDE VERIFICATION THAT THE DRAINAGE <br />AND UTILITY EASEMENT IS NOT NECESSARY AND UPON THE APPROVAL OF THE <br />CITY ENGINEER. <br /> <br />COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />6.8. Norwest Banks - Consider Amendment to Conditional Use Permit to Allow Ri.qht-in- <br /> <br />Only <br /> <br />City Engineer Terry Maurer reviewed the proposal by Norwest Bank to a "right-in <br />only" access off Jackson Road. Terry explained how the curb line would be <br />extended down from the north to discourage left turns by vehicles moving south <br />on Jackson, and, placing of "Do Not Enter" signs inside the site to warn vehicles <br />that the access is not an exit. <br /> <br />The City Engineer also discussed acquiring 10 feet of right of way to develop a <br />right turn lane at 193~d and Highway 169. Staff believes it may be possible to <br />relocate Norwest's proposed sign to the originally shown location, or, the city may <br />consider vacation a small portion of the 40 foot drainage and utility easement for <br />placement of the sign. <br /> <br />Councilmember Dietz asked if staff is recommending approval of the right-in-only <br />access. Terry Maurer indicated staff is not recommending the access and he is <br />only showing how the access would work. Councilmember Dietz indicated Phil <br />Hals, Streets/Parks Superintendent, has expressed concerns regarding the access. <br /> <br /> <br />
