City Coundl Minutes Page 8 June 1,5, 1998 COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 4-0. Request by Edmond Martin for Easement Vacation, Public Hearin.q Case No. EV 98-2 Staff repod by Scott Harlicker. Chip Martin has requested the vacation of a portion of city right of way which was platted in Houlton's Addition, as pad of Sth street. The parcel is approximately 48 feet by 138 feet with an area of 6,624 square feet. If the easement vacation is approved, the property would become pad of Martin Plaza. Staff recommends denial of the request based on the findings listed in the staff repod. Mayor Duitsman opened the public hearing. Edmond (Chip) Martin, applicant, reviewed his plans for improving the property if the easement vacation were approved. Planning Commission Chair Tom Mesich indicated he has received information that the applicant plans to request a conditional use permit to operate a small used car sales lot at this location. There being no further public comments, Mayor Duitsman closed the public hearing. COUNCILMEMBER HOLMGREN MOVED APPROVAL OF RESOLUTION NO. 98-65, DENYING THE REQUEST TO VACATE A PORTION OF THE RIGHT OF WAY FOR 5TM STREET BASED ON THE FOLLOWING FINDINGS: THE RIGHT-OF-WAY PROVIDES A BUFFER BETWEEN THE INDUSTRIAL USES AND OUTDOOR STORAGE AREA NORTH OF THE RAILROAD TRACKS AND HIGHWAY 10. THE RIGHT-OF-WAY PROVIDES AN OPPORTUNITY TO EXTEND UTILITIES UNDER THE RAILROAD TRACKS FOR FUTURE CONNECTIONS OF UTILITIES BETWEEN THE NORTH SIDE OF THE RAILROAD TRACKS AND THE SOUTH SIDE. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. 6.6. Request by Vau.qhn Smith for Easement Vacation, Public Hearin.q Case No. EV 98-3 Staff report by Scott Harlicker. Vaughn Smith has requested the city vacate the portion of Simonet Drive which is now unused due to the street's realignment with Highway 10. Mr. Smith wishes to make the vacated easement part of his lot. Staff recommends approval of the request with the condition stated in the staff report. Mayor Duitsman opened the public hearing. There being no comments from the public, Mayor Duitsman closed the public hearing.
