City Coundl Minutes Page 8 <br />June 1,5, 1998 <br /> <br />COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />Request by Edmond Martin for Easement Vacation, Public Hearin.q Case No. <br />EV 98-2 <br /> <br />Staff repod by Scott Harlicker. Chip Martin has requested the vacation of a <br />portion of city right of way which was platted in Houlton's Addition, as pad of Sth <br />street. The parcel is approximately 48 feet by 138 feet with an area of 6,624 <br />square feet. If the easement vacation is approved, the property would become <br />pad of Martin Plaza. Staff recommends denial of the request based on the <br />findings listed in the staff repod. <br /> <br />Mayor Duitsman opened the public hearing. <br /> <br />Edmond (Chip) Martin, applicant, reviewed his plans for improving the property if <br />the easement vacation were approved. <br /> <br />Planning Commission Chair Tom Mesich indicated he has received information <br />that the applicant plans to request a conditional use permit to operate a small <br />used car sales lot at this location. <br /> <br />There being no further public comments, Mayor Duitsman closed the public <br />hearing. <br /> <br />COUNCILMEMBER HOLMGREN MOVED APPROVAL OF RESOLUTION NO. 98-65, <br />DENYING THE REQUEST TO VACATE A PORTION OF THE RIGHT OF WAY FOR 5TM STREET <br />BASED ON THE FOLLOWING FINDINGS: <br /> <br />THE RIGHT-OF-WAY PROVIDES A BUFFER BETWEEN THE INDUSTRIAL USES AND <br />OUTDOOR STORAGE AREA NORTH OF THE RAILROAD TRACKS AND HIGHWAY <br />10. <br /> <br />THE RIGHT-OF-WAY PROVIDES AN OPPORTUNITY TO EXTEND UTILITIES UNDER <br />THE RAILROAD TRACKS FOR FUTURE CONNECTIONS OF UTILITIES BETWEEN THE <br />NORTH SIDE OF THE RAILROAD TRACKS AND THE SOUTH SIDE. <br /> <br />COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />6.6. <br /> <br />Request by Vau.qhn Smith for Easement Vacation, Public Hearin.q Case No. <br />EV 98-3 <br /> <br />Staff report by Scott Harlicker. Vaughn Smith has requested the city vacate the <br />portion of Simonet Drive which is now unused due to the street's realignment with <br />Highway 10. Mr. Smith wishes to make the vacated easement part of his lot. <br />Staff recommends approval of the request with the condition stated in the staff <br />report. <br /> <br />Mayor Duitsman opened the public hearing.
