City Council Minutes Page ? <br />June 15, 1998 <br /> <br />AND, CONTINGENT UPON AN OPINION FROM THE CITY ATTORNEY ON THE <br />FOLLOWING CONDITION: <br /> <br />13. <br /> <br />THE DEVELOPER GRADE AND SEED THE PROPOSED ROAD TO THE PLAT'S <br />WESTERN BOUNDARY AND PROVIDE THE CITY PAYMENT TO INSTALL CLASS V <br />AND BITUMINOUS AT A LATER DATE. <br /> <br />COUNCILMEMBER THOMPSON SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />6.4. <br /> <br />Request by Gene Thompson for Administrative Subdivision, Public Hearin.q Case <br />No. AS 98-2 <br /> <br />Staff report by Scott Harlicker. Gene Thompson is requesting an administrative <br />subdivision to subdivide 40.28 acres located at the northeast comer of County <br />Road 1 and 217th Avenue, into a 2.5 acre lot and a 37.78 acre lot. <br /> <br />Mayor Duitsman opened the public hearing. <br /> <br />Gene Thompson, applicant, stated he was not aware the city would be requiring <br />a 5 foot easement around the perimeter of the new lot, and questioned why the <br />easement was necessary. Scott Harlicker indicated the city routinely requires a 5 <br />foot drainage and utility easement for all administrative subdivisions for the <br />possibility it may be needed at some point in the future. <br /> <br />Carl (Gene) Thompson, owner of property proposed to be subdivided, expressed <br />his disapproval of aity government being involved in selling a piece of property to <br />his son. <br /> <br />Tom Thompson, brother of applicant, questioned if the five foot easement <br />requirement was a law. Scott Harlicl<er and Terry Maurer explained the <br />requirement was pall of the city's subdivision ordinance. <br /> <br />There being no other comments from the public, Mayor Duitsman closed the <br />public hearing. <br /> <br />COUNCILMEMBER DIETZ MOVED APPROVAL OF THE REQUEST BY GENE THOMPSON <br />FOR AN ADMINISTRATIVE SUBDIVISION, PUBLIC HEARING CASE NO. AS 98-2, WITH <br />THE FOLLOWING CONDITIONS: <br /> <br />1. DRAINAGE AND UTILITY EASEMENTS BE GRANTED TO THE CITY ALONG THE <br /> PROPERTY LINES OF THE PROPOSED 2.5 ACRE PARCEL. <br /> <br />PAYMENT OF PARK DEDICATION FEE IN THE AMOUNT OF $650 FOR THE NEW LOT <br />BEING CREATED TO BE PAID PRIOR TO RECORDING THE ADMINISTRATIVE <br />SUBDIVISION. <br /> <br />PAYMENT OF SURFACE WATER MANAGEMENT FEE IN THE AMOUNT OF $61.80 <br />FOR THE NEW LOT BEING CREATED TO BE PAID PRIOR TO RECORDING THE <br />ADMINISTRATIVE SUBDIVISION. <br /> <br />FURTHER SUBDIVISION OF THE 37 ACRE PARCEL IS LIMITED TO 2 LOTS FOR A <br />TOTAL OF 4 LOTS AND A DEED RESTRICTION BE RECORDED THAT RESTRICTS <br />FURTHER SUBDIVISION TO 2 LOTS. <br /> <br /> <br />
