Memo to Mayor and City Council/P 97-12 <br />February 9, 1998 <br />Page 4 <br /> <br />Phase I <br /> <br />As previously mentioned, Guardian Angels are proposing Phase I to consist of <br />the 20 townhomes and 60 units of assisted living. The additional 20 units of <br />assisted living and commercial project will require a conditional permit <br />reviewed by the Planning Commission and Council at a later date. <br /> <br />Shoreland Ordinance <br /> <br />The Department of Natural Resources has specific classifications for different <br />types of water bodies throughout the City of Elk River. Lake Orono is <br />considered a general development lake which has certain restrictions that <br />extend 1,000 feet beyond the ordinary high water mark of the lake. This <br />1,000 foot dimension includes all of Guardian Angels' property and is <br />therefore, subject to the Shoreland Management Ordinances and criteria to <br />preserve the integrity of the natural resource. <br /> <br />The first step in applying the Shoreland Ordinance to a piece of property is to <br />determine the number of tiers which will affect the property. These tiers are <br />measured is 200 foot increments radiating out away from the lake. Guardian <br />Angels' property has actually four tiers, however, all of the development is <br />occurring in the first three tiers. <br /> <br />Generally speaking, the Shoreland Ordinance allows a certain amount of <br />density or development within each tier. Some of the "base density" from one <br />tier may be transferred to the next as long as that tier is further away from <br />the lake. In no case shall the density be transferred from one tier back to a <br />tier closer to the lake. Essentially, there are incentives built in to transfer <br />more density away from the lake to further protect the natural resource. <br />Besides the "base density" an increased density can also be achieved by <br />meeting various enhanced performance standards. For example, these <br />performance standards include additional open space, storm water <br />management, vegetative protection and installation of additional <br />landscaping. Attached is a density evaluation form prepared by Michael <br />Trossen, architect for Guardian Angels, which outlines some of the setback <br />and density issues within each tier. <br /> <br />Impervious Surface Coverage <br /> <br />Within the Shoreland Ordinance there is a section which refers to the <br />maximum amount of impervious area (i.e., buildings, parking and driveways) <br />of 25% in tiers 2 and 3. These are the tiers where the assisted living and <br />commercial are proposed to be developed. Guardian Angels plans exceed the <br />25% impervious area coverage within tiers 2 and 3.
