(7) Wil/ fu/ly comply with all other requirements of this Code, including any applicable <br />requirements and standards for the issuance of a license or permit to establish and <br />operate the proposed use in the city. <br />4.3 WRITTEN STATEMENT ADDRESSING REQUIRED FINDINGS <br />Written statements regarding each of the required findings are provided below. <br />(1) Will not endanger, injure or detrimental/y affect the use and enjoyment of other property in <br />the immediate vicinity or the public hea/th, safety, morals, comfort, convenience or general <br />welfare of the neighborhood or the city. <br />An EIS was prepared and approved in 2006 for the initially-proposed 73.4-acre expanded Landfill. <br />The EIS evaluated potential impacts to groundwater, adjacent wetlands, and air quality and <br />determined that impacts from the proposed 73.4-acre expanded Landfill were expected to be <br />minimal, or that adequate mitigation plans were in place to address potential impacts. <br />Consistent with its approved CUP for the existing Landfill, the following standards will continue to <br />be met for the expanded Landfill: <br />Groundwater. The expanded Landfill, as designed, is a modern, lined landfill that meets or <br />exceeds all health and safety regulatory requirements. Modern landfills are designed to <br />protect groundwater by preventing a release from contacting the environment outside of the <br />landfill and by minimizing the volume of liquid (leachate) that could impair groundwater <br />quality in the event of a release. Groundwater monitoring networks and monitoring programs <br />are additional design features that detect changes in water quality that can indicate a failure <br />of the liner system before it becomes a health risk and to allow for implementation of <br />corrective actions to prevent an impact to the environment. Federal, state, and county <br />regulations establish siting, monitoring, water quality, and other standards to protect <br />groundwater resources. ERL will maintain backup pumps or will maintain provisions to <br />restore leachate pumping capabilities for use in the event of pump failure at the <br />leachate sump, wet well and leachate storage tank on-site. ERL will adhere to the <br />~~Leachate Management Plan" as approved by MPCA. <br />Leachate Storage Tank. ERL will ensure that existing and/or proposed leachate tanks are <br />pumped out on a regular schedule.
