Design of any additional proposed buildings/structures has not been completed. The approximate
<br />location of these additional building/structures is shown on the °Site Development Plan" would be
<br />in accordance with the May 25, 2011 Agreement.
<br />^ Signage (how many, proposed sizes, locations, type)
<br />ERL will maintain a sign at each entrance to the site which describes the wastes which may be
<br />disposed at the Landfill, including the expanded Landfill, and those wastes which will not be
<br />accepted. In addition to waste acceptance information, the site signage will also indicate the
<br />schedule of days and hours the facility is open to the public, prices for waste disposal at the site,
<br />the MPCA permit number, and a contact phone number for the Landfill.
<br />No new entrances are proposed for the expanded Landfill and, therefore, new signage will not be
<br />required.
<br />^ Outdoor storage (what, how much, proposed screening)
<br />No outdoor storage is proposed. Adequate on-site enclosed storage is available for the
<br />maintenance and storage of the landfill equipment that is currently needed to operate the landfill.
<br />4.2 CONDITIONAL USE PERMIT STANDARDS OF ISSUANCE
<br />The Elk River Code, Chapter 30. Land Development Regulations, Article VI. Zoning, Division 2.
<br />Administration and Enforcement, Subdivision III. Conditional Use Permits, governs the issuance
<br />of conditional use permits and establishes the following required findings:
<br />Sec. 30-654. Standards for issuance,
<br />(a) Required findings, The p/arming commission shall recommend a conditional use permit and
<br />the council sha/l order the issuance of such a permit only if it finds that such use at the proposed
<br />location:
<br />(I) Will not endanger, injure or detrimentally affect the use and enjoyment of other
<br />property in the immediate vicinity or the public health, safety, mora/s, comfort,
<br />convenience or general welfare of the neighborhood or the city.
<br />(2) Wi/l be consistent with the comprehensive plan.
<br />(3) Will not impede the normal and order/y deve%pment and improvement of
<br />surrounding vacant property,
<br />(4) Wi// be served adequate/y by and wi/l not adversely affect essential pub/ic facilities
<br />and services including streets, po/ice and fire protection, drainage, refuse disposal, water
<br />and sewer systems, parks and schoo/s; and wi//not, in particular, create traffic
<br />congestion or interference with traffic on adjacent and neighboring pub/ic thoroughfares.
<br />(5) Wi/l not involve uses, activities, processes, materials, equipment and conditions of
<br />operation that will be detrimental to any persons or property because of excessive traffic,
<br />noise, smoke, fumes, g/are, odors, dust or vibrations,
<br />(6) Will not resu/t in the destruction, loss or damage of a natural, scenic or historic
<br />feature of major importance.
