Act means the Minnesota Government Data Practices Act, Minnesota Statutes Chapter 13, as <br />amended. <br />Authorized programs are those plans or procedures established by federal law, state statute or <br />local governing body. <br />City means the City of Elk River, Minnesota. <br />Confidential Data on Individuals. Pursuant to Minn. Stat. § 13.02, subd. 3, confidential data <br />on individuals means data which is made not public by statute or federal law applicable to the <br />data and is inaccessible to the individual subject of the data. "Confidential" as used in some <br />Minnesota Statutes and federal laws may actually mean "private data on individuals" as defined <br />in Minn. Stat. § 13.02, subd. 12, if the data is accessible to the data subject. (Minn. Stat. § <br />13.02, subd. 3; Minn. Rules, Pt. 1205.0,200, subp. 3) <br />Court Order means the direction of a court or judge made or entered in writing, and not <br />included in a judgment. <br />Data not on Individuals means all government data which is not data on individuals. (Minn. <br />Stat. § 13.02, subd. 4) <br />Data on Individuals means all government data in which any individual is or can be identitied <br />as the subject of the data, unless the appearance of the name or other identifying data can be <br />clearly demonstrated to be only incidental to the data and the data are not accessed by the name <br />or other identifying data of any individual. (Minn. Stat. § 13.02, subd. 5) <br />Data Practices Annual Report is a consolidation of some of the written reporting requirements <br />of the Act including: (1) the Annual Inventory of Records, (2) the list or index to all data or types <br />of data, and (3) the identification of the active and inactive records collected prior to after Aug. <br />1, 1975. <br />Data Subject means the individual or person about whom the data is created or collected. <br />Designee means any person designated by a Responsible Authority (a) to be in charge of <br />individual files or systems containing government data and (b) to receive and comply with <br />requests for government data. (Minn. Stat. § 13.02, subd. 6) <br />Enabling Authority means the state, federal or local law that authorizes the program or function <br />for which the data is collected, or which authorizes the actual data collection, storage, use or <br />dissemination. <br />Entity means any governmental agency subject to the requirements of the Act including state <br />agencies, political subdivisions and statewide systems. <br />CAH50884 <br />GA115-26 53 <br />
