denial, either orally at the time of the request or in writing as soon after that as possible, citing <br />the specific state or federal law upon which the denial is based. Upon request of any person <br />denied access to data, the Responsible Authority or designee shall certify in writing that the <br />request has been denied and cite the specific statutory section, temporary classification, or specific <br />provision of federal law upon which the denial was based. (Minn. Stat. § 13.03, subd. 3) <br />� G. Commissioner Opinions._ <br />1. Opinions provided by Commissioner. The Commissioner of Administration is <br />authorized to issue non-binding opinions on questions relating to public access to government <br />data, rights of subject of data or classification of data under Minnesota law. An agency statewide <br />system, political subdivision or person who acts in conformity with a Commissioner opinion is <br />not liable for compensatory or exemplary damages, or awards of attorneys' fees, or penalties in <br />actions under Sections 13.08 and 13.09 of the Act. The cost of an opinion is $200. (Minn. Stat. <br />§ 13.072) <br />2. Responsible Authority to request. The Responsible Authority, with the prior approval <br />of the city administrator and advice of the city attorney, may request an opinion from the <br />Commissioner whenever it is in the City's interest to do so. <br />3. Opinions to be distributed. The Responsible Authority will keep himself/herself advised <br />of all opinions issued by the Commissioner. The Responsible Authority will distribute to all <br />department heads copies of opinions that are applicable to City data. Department heads and <br />Authorized Employees will handle City data in accordance with Commissioner opinions except <br />when directed otherwise by the Responsible Authority and City administrator. The Responsible <br />Authority and City administrator may, after consulting with the city attorney, direct department <br />heads and City employees to disregard a Commissioner opinion that appears to be in conflict. <br />CAHS0884 <br />GAIIS-26 35 <br />
