b. No form is required where private or nonpublic data is routinely shared with or <br />provided to an authorized government entity in the normal course of business. <br />Private or nonpublic data may not be released over the telephone to a person <br />representing themselves to be with a government entity authorized to have access <br />unless: (1) the authorized employee recognizes the voice of the requesting person <br />as that of a government employee authorized to have access; or (2) the authorized <br />employee placed the telephone call to the government entity. (Minn. Rules, Pt. <br />1205.0500, subp. 3) <br />D. Requests for Confidential Data on Individuals or Protected Nonpublic Data Not <br />on Individuals. <br />1. Scope. This Section 7.D applies to all requests for confidential data on individuals or <br />protected nonpublic data not on individuals, except requests related to or made by a party in <br />litigation with the City or that is requested by subpoena. See Section TE. <br />2. Hours. Requests for access to confidential data on individuals or protected nonpublic data <br />not on individuals must be made during normal business hours. (Minn. Rules, Pt. 1205.0500, <br />subp. 4) <br />3. Access by Individuals. The Responsible Authority or designee may not provide access <br />to confidential data on individuals or nonpublic data not on individuals to any person except those <br />authorized by law to have access. (See Section 2.D.4.) The Responsible Authority or designee <br />shall seek the advice of the city attorney before responding to any request by an individual for <br />confidential data on individuals or nonpublic data not on individuals. <br />4. Government Access. <br />a. The Responsible Authority or designee may allow other government agencies to <br />have access to confidential data on individuals or protected nonpublic data not on <br />individuals only when the access is authorized or required by statute or federal <br />law. (Minn. Stat. § 13.05, subd. 9) <br />b. Data has the same classification in the hands of the agency receiving it as it has <br />in the hands of the agency providing it, unless the classification is required to <br />change to meet judicial or administrative requirements. (Minn. Stat. § 13.03, <br />subd. 4) When practical and necessary, the Responsible Authority or designee <br />shall indicate the classification of not public data that the Responsible Authority <br />or designee provides to a requesting government agency. <br />5. Time for Response. The Responsible Authority or designee will respond to all requests <br />for confidential data on individuals or protected nonpublic data not on individuals in a reasonably <br />prompt manner. <br />CAH50884 <br />GA115-26 33 <br />
