5. Time for Response. Within 10 days of receipt of a request for summary data, the <br />Responsible Authority or designee shall inform the requestor of the estimated costs of preparing <br />the summary data, if any, and either: <br />a. Provide the summary data requested; or <br />b. Provide a written statement to the requestor, giving a time schedule for preparing <br />the requested data, including reasons for any delays; or <br />c. Provide access to the requestor to the private or confidential data so that the <br />requestor can compile the summary data. Such access will be provided only when <br />the requestor signs a nondisclosure agreement (see below); or <br />d. Provide a written statement to the requestor stating reasons why the requestor's <br />access would compromise the private or confidential data. (Minn. Rules, Pt. <br />1205.0700, subp. 4.) <br />6. Non -Disclosure Agreement. A non -disclosure agreement (see Exhibit P) must be <br />obtained whenever the person who prepares the summary data is an "outside person," i.e., not a <br />City employee. A non -disclosure agreement must contain at least the following: <br />a. a general description of the private or confidential data which is being used to <br />prepare summary data (Minn. Rules, Pt. 1205.0700, subp. 5); and <br />b. the purpose for which the summary data is being prepared (Minn. Rules, Pt. <br />1205.0700, subp. 5); and <br />C. a statement that the preparer understands s/he may be subject to the civil or <br />criminal penalty provisions of the Act in the event that the private or confidential <br />data is disclosed (Minn. Rules, Pt. 1205.0700, subp. 5); and <br />d. a section in which the preparer agrees not to disclose data in any form that would <br />identify or tend to identify an individual, and that he also agrees to defend and <br />indemnify the City and any of its employees in any legal actions brought as a <br />result of his/her having access to private or confidential data; and <br />e. a description of the civil and criminal penalty provisions of the Act; and <br />f the signature of the preparer and the Responsible Authority. <br />7. Costs of Preparing Summary ➢ata. The requesting person must pay all costs of <br />preparing the summary data. <br />a. The costs to be assessed include- (i) copy charges as set forth in Exhibit H, <br />amended from time to time by the Responsible Authority; (ii) actual labor charges <br />incurred by the City, which shall be determined by multiplying the hourly rate of <br />the employee preparer times the total hours or portion thereof spent in preparing <br />CAH50884 <br />GA115-26 27 <br />
