Memo to the Mayor and City Council/P 96-13 Page 3 <br />March 17, 1997 <br /> <br />project. This sidewalk system would ultimately continue to the east of <br />Proctor along Highland Road ultimately connecting with Jackson. At this <br />time there is no schedule when this sidewalk along Highland would be <br />installed. <br /> <br />193rd Avenue <br /> <br />The proposed plat shows the cul-de-sacing of 193rd Avenue approximately <br />300 feet west of Proctor Road. The closing of 193rd Avenue to vehicle traffic <br />is an issue that staff originally presented when the Lafayette Woods <br />development was brought before the Planning Commission and City Council. <br />Although this concept has never been officially adopted by the Council, it is <br />an idea that has been endorsed by the Park and Recreation Commission as <br />they support converting 193rd Avenue to a pedestrian corridor from Proctor <br />west to the main city trail (former railroad property). The City Engineer <br />believes by closing 193rd Avenue, the "cut-through" trips will be eliminated <br />and traffic will utilize the county road (Proctor) which will carry the traffic to <br />County Road No. I to a future signahzed intersection. <br /> <br />During the Planning Commission public hearings, one of the property owners <br />immediately south of 193rd (Mrs. Carton) has expressed a concern with <br />closing 193rd Avenue, as it may prevent access to her property for <br />development. Mrs. Carton's property also borders County Road No. i on the <br />south which, if necessary, could provide access to her property. However, <br />minimizing access points onto a county road would be the preferred choice <br />and utilize the existing local streets for access purposes. Staff has researched <br />this further and have concluded that ff Mrs. Carton's property is developable, <br />access to her property could be obtained from a cul-de-sac extending from the <br />west along 193rd. This design would still achieve a pedestrian corridor <br />while, at the same time, eliminating the cut-through traffic between Proctor <br />and County Road No. 1. <br /> <br />Another point worth noting regarding Mrs. Carton's property pertains to <br />some Council action that was taken back on February 27, 1989. Basically, at <br />that meeting, the City Council passed a resolution reducing to zero and <br />cancehng from the assessment roll, assessments in the amount of $1,569.89 <br />because of Mrs. Carton's request that the assessment was unjust and would <br />create an undue burden upon her. Furthermore, the property that was <br />assessed was determined to be unbuildable due to a large wetland complex. <br />Therefore, staff questions Mrs. Carton's concern to have access to her <br />property which was deemed unbuildable, along with the assessments being <br />withdrawn.
