Memo to the Mayor and City Council/CU 96-19
March 3, 1997
Page 2

After hearing testimony from the residents, the Planning Commission could
not support Derrick Investment's request based on the plan that has been
approved. Therefore, the Planning Commission recommended denying
Derrick Investment's request to amend the PUD agreement based on the
testimony from the residents and the approved site plan that was based on a
55 year and older project. The Commission would like to review the site plan
to address the issues discussed if the residency requirement is removed.

Recommendation

Mr. Derrick has asked that the City Council continue the pubhc hearing to
the March 17th City Council meeting to allow time to work on the issues
raised at the Planning Commission meeting. Staff would support this
request and therefore, recommend the City Council open the public hearing,
receive public testimony and continue the public hearing to March 17th to
take action on this item.

s:\councilXcu96-19.doc
