<br />lhf:lc:02:3l9-04 <br /> <br />ORDINANCE No. 78-10 <br /> <br />AN ORDINANCE AMENDING ORDINANCE NO. 8.05 OF THE ELK RIVER MUNICIPAL CODE RELATING <br />TO SPECIAL LICENSES PERMITTING THE SALE OF INTOXICATING LIQUOR ON SUNDAYS <br /> <br />The City Council of the City of Elk River does ordain as follows: <br /> <br />Section 1. That Section 2 of Ordinance No. 8.05 of the Elk River Municipal Code <br /> <br /> <br />be amended to read as follows: <br /> <br />SECTION 2. License Required. <br />Subdivision 1. General Requirement; Hours and Days Regulated. <br /> <br />(a) No person, except a wholesaler or manufacturer to the extent authorized under <br /> <br />state license, shall directly or indirectly deal in, sell, or keep for sale in <br /> <br />the. city any intoxicating liquor without a license to do so as provided in this <br /> <br />ordinance. Liquor licenses shall be of three kinds: "on-sale", special club <br /> <br />licenses, and special licenses permitting the sale of intoxicating liquor on <br /> <br />Sundays. <br /> <br />(b) No sale of intoxicating liquor shall be made after 1:00 a.m. on Sunday, nor <br /> <br />until 8:00 a.m. on Monday, except as hereinafter provided, nor between the <br /> <br />hours of 1:00 a.m. and 8:00 p.m. on the day of any state-wide election. No <br /> <br />lion-sale" shall be made between the hours of 1:00 a.m. and 8:00 a.m. on any <br /> <br />weekday. <br /> <br />Subdivision 2. On-sale Licenses. <br /> <br />"On-sale" licenses shall be issued only to hotels and res taurants having a seating <br /> <br />capacity of not less than 100 guests at one time and shall permit "on-sale" of <br /> <br />liquor only. <br /> <br />Subdivision 3. Special Club Licenses. <br />Special club licenses shall be issued only to incorporated clubs which have been <br /> <br />in existence for 15 years or more or to congressionally chartered veterans' organi- <br /> <br />zations which have been in existence for 10 years. <br />
