<br />VILLAGE OF ELK RIVER COUNCIL MEETING <br />August 1, 1938 <br /> <br />The regular meeting of the Village Council was held at the Municipal Building Monday Aug 1, 1938 <br />at 8 o’clock P.M. <br /> <br />Members present: <br />Frank Nickerson, Pres.; G.A. Bailey, Wm Patenaude, Geo Cornelius, Trustees; <br />Wm H Greupner, Clerk. <br /> <br />Minutes of last meeting were read and approved. <br /> <br />Resolution by Village Council to vacate street <br /> <br />The above entitled matter came on to be heard before the Village Council of the Village of Elk <br />River, upon a petition duly filed by George E Lowe for the vacation of all that part of Vine Street in <br />the Taconsite of Orono, in said Village of Elk River between the Trunk Highway and the Elk River <br />mill pond, so-called in the County of Sherburne, State of Minnesota and the Village Council having <br />st <br />given due notice of said hearing by all published and posted notice thereof to be had on the 1 day <br />of August 1938 at the Council Room in the Municipal Building IN said Village at the hour of eight <br />o’clock P.M. and no one appearing in opposition thereto and the said Council after hearing the <br />evidence presented to it in for or of said petition that the said street had never been used or open to <br />use by the public and that it would be to the best interests of the public to vacate the same, <br /> <br />Councilman G.A. Bailey introduced the following resolution, to wit: that the part of Vine Street in <br />the Taconsite of Orono, in said Village of Elk River between the Trunk Highway and the Elk River <br />mill pond – so called be and same is hereby vacated. <br /> <br />Which said resolution was seconded by Councilman George Cornelius and a majority of said <br />Council voted in favor of said resolution thereupon said resolution was declared adopted by the <br />President of the Council. <br />Dated at the Village of Elk River, August 1, 1938 <br />Attest Wm H Greupner, Clerk <br />F.M. Bailey seconded by Wm Patenaude that Whereas the Village of Elk <br />River has no further use for the land hereinafter described and that the offer of $1000.00 therefore <br />by the State of Minnesota be and the same is hereby accepted and that the President and the Clerk <br />of Village Council be and they are hereby authorized and directed to execute to the State of <br />Minnesota, a Warranty Deed therefor, of the said Village of Elk River, to all the following described <br />tracts, situate in the County of Sherburne, State of Minnesota. <br /> <br />That Part of Lot 13, Auditor’s Subdivision No. 4 of Government Lot 3 in Section 34, Township 33, <br />North, Range 26 West, according to the plat thereof now on file and of record in the office of the <br />Register of Deeds in and for Sherburne County described as follows: Beginning at a point on the <br />east line of Lot 5, Block 8, Village of Elk River a distance of 150 feet south from the northeast <br />corner thereof: thence running south along said east line of said Lot 5 to the east bank of the <br /> <br />
