~ity of <br /> <br />iver <br /> <br />ITEM 5.4. <br /> <br />MEMORANDUM <br /> <br />TO: <br /> <br />FROM: <br /> <br />DATE: <br /> <br />Mayor and City Council / /~ _ t <br />Kendra Lindahl, Zoning Assista <br /> <br />January 8, 1996 <br /> <br />SUBJECT: Abolish Refuse Appeal Board <br /> <br />The Refuse Appeal Board is composed of five members: Kendra Lindahl, Pat <br />Klaers, Madalyn Moos, Cindy Olson and Councilmember John Dietz. In the <br />past, Council has appointed a Councilmember to the Refuse Appeal Board on <br />a yearly basis. In 1992, two citizens were appointed to the Board--Cindy <br />Olson was appointed to a two year term and Madalyn Moos was appointed to <br />a one year term. If Council wishes to continue the Refuse Appeal Board, they <br />must appoint a Councilmember to a one year term and they must appoint <br />two citizens to the board, as both citizen terms have expired. <br /> <br />However, since there were no Refuse Appeal Board meetings in 1994 or 1995, <br />staff feels that Council should abolish the Refuse Appeal Board. Appeals will <br />be handled at a staff level by City Administrator Pat Klaers and myself. <br />Since the number of appeals has declined as citizens begin to accept the <br />mandatory pickup ordinance, staff does not foresee having more than one or <br />two appeals a year. As always, staff decisions would be appealed to the City <br />Council. <br /> <br />Enclosed is a copy of the City Ordinance Section allowing Council to establish <br />an appeal board as necessary. Consequently, the Council may dissolve the <br />appeal board when it no longer serves a function. <br /> <br />Action Requested <br /> <br />Council should abolish the Refuse Appeal Board and direct staff to handle <br />any refuse appeals at the staff level. <br /> <br /> S:\PLANNING\KENDRA\CCREFUSE.DOC <br />13065 Orono Parkway · P.O.
