AND MRS. LESLIE <br />ANDERSON/PUBLIC HEARING <br />CASE NO. AS 93-02 <br /> <br />Mr. and Mrs. Anderson are requesting to subdivide a 17.9 acre <br />parcel into three parcels. Map #1 attached to this memo shows <br />the location of the affected property. <br /> <br />ADMINISTRATIVE SUBDIVISION PROCEDURE <br /> <br />An administrative subdivision is typically a shortened version <br />of a plat where lots splits result in platted legal <br />descriptions. The City does allow the creation of one <br />additional residential lot resulting in a metes and bounds <br />description. You will note the Andersons are requesting two <br />additional lots with metes and bounds descriptions. <br /> <br />. <br /> <br />In 1989, a Mr. Robert Bowersox, the previous owner of this <br />parcel, was given approval to subdivide the 17.9 acre parcel in <br />question into a 10 acre parcel and a 7.9 acre parcel. The two <br />parcels are noted on the attached Map #2. <br /> <br />The deed from Mr. Bowersox to the Andersons had one legal <br />description for the 17.9 acres in question and, consequently, <br />inadvertently combined the two lots. Staff recommends the <br />Council consider the 17.9 acre parcel as currently two parcels, <br />therefore, the Andersons are requesting to create one <br />additional lot and rearrange two existing lots. This meets the <br />City requirements regarding lots described by metes and bounds. <br /> <br />PARK DEDICATION <br /> <br />When Mr. <br />paid Park <br />created. <br />additional <br /> <br />Bowersox split the 17.9 acre parcel into two lots, he <br />Dedication Fees for one additional lot being <br />Staff recommends that the Andersons pay for one more <br />lot being created from this parcel ($400). <br /> <br />COUNTY REVIEW <br /> <br />. <br /> <br />Staff was unable to obtain comment from the County Engineer's <br />office regarding additional right-of-way along County Road #32 <br />prior to this memo. Staff does anticipate the County <br />requesting 17 feet of additional right-of-way along County Road <br />#32. This can be accomplished by easement which will not <br />affect setbacks or lot size.
