The 2011 AgYeement for Issuance of Amended Conditional Use <br />Permit shall be amended to allo`v the construction and use of a <br />stoYmwateY pond on a parcel (75-104-1101) outside of the Solid <br />Waste FacilityT (SWF) overlayT district. <br />2. There shall be no additional Municipal Solid Waste capacityT beyTond <br />what was approved in 2011. <br />Background/Discussion <br />Case No. CU 23-09 - The Elk River Landfill (ERL) is requesting a <br />Conditional Use PeYmit (CUP) to amend their e�sting CUP to incorpoYate <br />appro�matelyT 20 additional acres of property, immediately to the south of <br />the currently permitted landfill footprint The additional land provides no <br />additional Municipal Solid Waste capacityT (landfill expansion) but will be <br />used for improved/required stormwater management. <br />Planning Commission <br />During the public hearing, no one spoke for or against the request and <br />staff has not received anyT comments since the commission meeting.
