Request for Action
To Item Number
Plannin Commission 4.2b
Agenda Section Meeting Date Prepared by
Public Hearings MaT 23, 2023 Chris Leeseberg, Senior Planner
Item Description Reviewed by
Waste Management — Elk River Landfill, 11711 221st Zack Carlton, Communi r Develo ment DirectoY
Ave. NW / 22460 US Hwy. 169 Reviewed by
Conditional Use PeYmit Amendment to Include Suzanne Fischer, Environment Services/Special PYojects
Additional Property to Improve Stormwater Director
Mana ement, Case No. CU 23-09
Action Requested
Recommend, byT motion, approval of the Conditional Use Permit with
the follo`ving conditions:
1. The 2011 Agreement for Issuance of Amended
Conditional Use Permit shall be amended to allow the
construction and use of a stormwater pond on a parcel
(75-104-1101) outside of the Solid Waste Facilityr (SWF
overlay district.
2. There shall be no additional Municipal Solid Waste
capacityr beyond what was approved in 2011.
Background/Discussion
The Elk River Landfill (ERL) is requesting a Conditional Use Permit
(CUP) to amend their esting CUP to incorporate appYoxirnatelyr 20
additional acres of propertyT, immediately to the south of the currently
permitted landfill footprint The additional land provides no additional
Municipal Solid Waste capacitT (landfill expansion) but `vill be used
for improved/required stormwater management.
In oYder to process the CUP amendment, ERL also Yequested an
ordinance amendment (OA 23-02) to allow for stormwater
management features foY the landfill to be located outside of the SWF
.
• ..
_ ` . The previous
design had stormwater discharge from the site under the exterior roadwayT, then under the city trail, and ultimatelyT
to an upstream wetland on pYopeYtyr owned byr ERL. The modified design allows foY discharge directly west of the
proposed pond to an existing low area, on propertyT also owned byT the Landfill, east of the trail, eliminating the
need for the citT trail crossing.
The Elk River Vision
A 2aelcolning conlnunity 2aith evolutiona y and spizzted T esou cefulness, exceptional
sevice, and colnnunity engageynent that encouages and insiz•es propezty.
rowREo ar
I'1
Updatel• January 2023
