The 2011 Agreement for Issuance of Amended <br />Conditional Use Permit shall be amended to allow the <br />construction and use of a stormwater pond on a parcel <br />(75-104-1101) outside of the Solid Waste Facilityr (SWF� <br />overlay district. <br />2. There shall be no additional Municipal Solid Waste <br />capacityr beyond what was approved in 2011. <br />Background/Discussion <br />The Elk River Landfill (ERL) is requesting a Conditional Use Permit <br />(CUP) to amend their e�sting CUP to incorporate appYoxirnatelyr 20 <br />additional acres of propertyT, immediately to the south of the currently <br />permitted landfill footprint The additional land provides no additional <br />Municipal Solid Waste capacit�T (landfill expansion) but `vill be used <br />for improved/required stormwater management. <br />In oYder to process the CUP amendment, ERL also Yequested an <br />ordinance amendment (OA 23-02) to allow for stormwater <br />management features foY the landfill to be located outside of the SWF <br />. <br />• .. <br />_ ` . The previous <br />design had stormwater discharge from the site under the exterior roadwayT, then under the city trail, and ultimatelyT <br />to an upstream wetland on pYopeYtyr owned byr ERL.
