The general purpose and intent of the ordinance are met. <br />2. The property has a land use of residential and the use is <br />consistent with the comprehensive plan. <br />3. The proposed use is reasonable and is permitted in the zoning <br />ordinance. <br />4. The plight of the petitioner is due to circumstances unique to <br />the property not a consequence of the petitioner’s own action <br />or inaction. <br />5. The variance will not alter the essential character of the locality. <br /> <br />Background/Discussion <br />The applicant is requesting a setback variance to install a 10-foot-wide <br />driveway approximately 8 inches from the south property line. The <br />required setback for driveways is 5 feet. The proposed driveway will <br />provide access the existing accessory structures located on the <br />property. <br /> <br />Majestic Oaks was platted in 2021 and the subject property includes <br />the existing home and accessory structures from the land prior to <br />platting. The access that was in place to the existing accessory <br />structures now crosses multiple lots created when the property was developed and can no longer be used. <br /> <br />The house is approximately 25 feet higher than the accessory structures with the contours north of the house <br />being a bit steeper than on the south. The septic system is located behind (east) the house and limits where a <br />driveway could be placed along the south property line.
