Commissioner's Johnson. <br />Olsen. Kimball and Fuchs <br /> <br />MEMBERS ABSENT: <br /> <br />Commissioner Morton and Barrett <br /> <br />STAFF PRESENT: <br /> <br />Stephen Rohlf. Building and Zoning Administrator; and <br />Steve Bjork. Zoning Assistant <br /> <br />1. Pursuant to due call and notice thereof. the meeting of the Elk River <br />Planning Commission was called to order at 7:00 p.m. <br /> <br />2. Consider 7/26/88 Planning Commission Agenda <br /> <br />Item 12.5 - follow up review of stipulations set on conditional use permit <br />was added to the agenda. <br /> <br />3. <br /> <br />Consider 6/28/88 Planning Commission Minutes <br /> <br />Commissioner Fuchs noted that on page 3. paragraph 10. it should say <br />"agreeable" instead of "agreedable." Also on page 4. the motion should <br />read 5-0 with one abstension. On page 6. the motion to have Staff pursue <br />the moving of the powerline above Ken Beaudry's property should be moved <br />to page 5 following the motion for item #10. <br /> <br />COMMISSIONER FUCHS MOVED TO APPROVED <br />COMMISSIONER KIMBALL SECONDED THE MOTION. <br /> <br />THE 6/28/88 MINUTES AS AMENDED. <br />THE MOTION PASSED 5-0. <br /> <br />4. Consider Variance Request by Ross and Shelly Stark/Public Hearing <br /> <br />Chairman Kropuenske read the five standards for granting a variance. <br /> <br />Steve Bjork introduced the item by stating that Ross and Shelly Stark are <br />requesting a 17 foot encroachment on the required 20 foot side yard <br />setback in a R-IA zone. <br /> <br />The building permit was issued in October of 1986 to Mr. Michael DeMars. <br />At that time. the survey showed the structure having the necessary <br />setbacks. <br /> <br />When construction began. the the structure was inadvertantly moved to the <br />south. The garage was also moved to the south side of the structure. The <br />house was constructed at a 3 foot side yard seback instead of the required <br />20 foot setback. The applicants were not the owners at the time of <br />construction. <br /> <br />Chairman Kropuenske opened the public hearing. Since no one appeared for <br />or against the item. Chairman Kropuenske closed the public hearing. <br /> <br />COMMISSIONER OLSEN MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF THE <br />VARIANCE REQUEST BY ROSS AND SHELLY STARK FOR A 17 FOOT ENCROACHMENT ON <br />THB RIQUIRBD 20 rOOT SIDE YARD SETBACK. COMMISSIONER FUCHS SECONDED THE <br />MOTION. THE MOTION PASSED 5-0. <br />
