. . . MINUTES OF THE ELK RIVER PLANNING COMMISSION HELD AT THE ELK RIVER PUBLIC LIBRARY JULY 26. 1988 MEMBERS PRESENT: Chairman Kropuenske. Commissioner's Johnson. Olsen. Kimball and Fuchs MEMBERS ABSENT: Commissioner Morton and Barrett STAFF PRESENT: Stephen Rohlf. Building and Zoning Administrator; and Steve Bjork. Zoning Assistant 1. Pursuant to due call and notice thereof. the meeting of the Elk River Planning Commission was called to order at 7:00 p.m. 2. Consider 7/26/88 Planning Commission Agenda Item 12.5 - follow up review of stipulations set on conditional use permit was added to the agenda. 3. Consider 6/28/88 Planning Commission Minutes Commissioner Fuchs noted that on page 3. paragraph 10. it should say "agreeable" instead of "agreedable." Also on page 4. the motion should read 5-0 with one abstension. On page 6. the motion to have Staff pursue the moving of the powerline above Ken Beaudry's property should be moved to page 5 following the motion for item #10. COMMISSIONER FUCHS MOVED TO APPROVED COMMISSIONER KIMBALL SECONDED THE MOTION. THE 6/28/88 MINUTES AS AMENDED. THE MOTION PASSED 5-0. 4. Consider Variance Request by Ross and Shelly Stark/Public Hearing Chairman Kropuenske read the five standards for granting a variance. Steve Bjork introduced the item by stating that Ross and Shelly Stark are requesting a 17 foot encroachment on the required 20 foot side yard setback in a R-IA zone. The building permit was issued in October of 1986 to Mr. Michael DeMars. At that time. the survey showed the structure having the necessary setbacks. When construction began. the the structure was inadvertantly moved to the south. The garage was also moved to the south side of the structure. The house was constructed at a 3 foot side yard seback instead of the required 20 foot setback. The applicants were not the owners at the time of construction. Chairman Kropuenske opened the public hearing. Since no one appeared for or against the item. Chairman Kropuenske closed the public hearing. COMMISSIONER OLSEN MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF THE VARIANCE REQUEST BY ROSS AND SHELLY STARK FOR A 17 FOOT ENCROACHMENT ON THB RIQUIRBD 20 rOOT SIDE YARD SETBACK. COMMISSIONER FUCHS SECONDED THE MOTION. THE MOTION PASSED 5-0.
