<br />VILLAGE OF ELK RIVER COUNCIL MEETING <br />October 4, 1937 <br /> <br />The regular meeting of the Village Council was held at the Municipal Bldg Mon Oct 4, 1937 at 8 <br />o’clock P.M. <br /> <br />Members present: <br />J.D. Flaherty, Pres.; G.A. Bailey, Geo Cornelius, Wm Patenaude, Trustees; <br />Wm H Greupner, Clerk. <br /> <br />The minutes of last meeting were read and approved. <br /> <br />Frank White, Village attorney, read a letter from Mr. Noonan, attorney for Mr. O.W. Farrell stating <br />that the reason they were not at the last council meeting in regards to the building permit for the Oil <br />Station was that they thought the council could act on it without there being present. A motion was <br />made by Wm Patenaude seconded by Geo Cornelius to table this matter. <br /> <br />L.G. Nelson, Pres of the Fairboard, Chas Bade, L.K. Houlton, Donald Davis, members of the <br />fairboard came before the Council and asked if the Council would grant them an appropriation for <br />the Sherburne County Fair as they had in the past years. A motion was made by Wm Greupner <br />seconded by Geo Cornelius to appropriate $25.00 to the Sherburne Co Fair Association. Motion <br />carried. <br /> <br />A committee representing the Elk River Merchants presented the Green River Ordinance to the <br />Council and asked to have it approved. A motion was made by Geo Cornelius seconded by Wm <br />Greupner to adopt the following Green River Ordinance. <br /> <br />Ordinance No. 36 <br />An Ordinance forbidding solicitors, peddlers, hawkers, itinerant merchants and transient vendors of <br />merchandise from trespassing in and upon private residences when uninvited to do so by the owners <br />and occupants of said private residences, in soliciting and attempting to solicit orders or in selling <br />and exposing for sale wares and merchandise and declaring such soliciting to be a nuisance and <br />directing the police authorizes to abate such nuisances and fixing the penalty for committing such <br />nuisances. <br />Be it ordained by the Village Council of the village of Elk River, State of Minnesota <br />Section 1 – The practices of going in and upon private residences in the Village of Elk River, <br />Minnesota by solicitors, peddlers, hawkers, itinerant merchants and transient vendors of <br />merchandise not having been requested or invited so to do by the owner or owners, occupant or <br />occupants of said private residences, for the purpose of soliciting orders for the sale of goods, wares <br />and merchandise and or for the purpose of desposing of and/or peddling or hawking the same, is <br />hereby declared to be a nuisance, and punishable as such nuisance as a misdemeanor. <br />Section 2 – The Village Marshall and police force of the Village of Elk River are hereby required and <br />directed to suppress the same and to abate any such nuisance as is described in the first section of <br />this ordinance. <br />Section 3- Any person convicted or perpetrating a nuisance as described and prohibited in the first <br />section of this ordinance upon conviction thereof shall be fined a sum not less than twenty-five <br /> <br />
