~ REGULAR SEMI-MONTHLY MEETING OF THE ELK RIVER CITY COUNCIL HELD AT THE ELK RIVER PUBLIC LIBRARY MAY 17, 1982 Members Present: Mayor Hinkle, Councilmembers Schuldt, Engstrom, Toth and Duitsman Members Absent: None 1. The meeting was called to order at 7:30 p.m. by Mayor Hinkle. 2 . Agenda Item 7 - Baptists Church Variance, was deleted and Item 12 - Consideration of the Construction of Sidewalks on Irving Avenue, was moved to the Item 7 position. Item 5~ - the City Beautification Committee and Item l8E - the City Audit and Liquor In- ventory were added to the May 17th, 1982 City Council Agenda. COUNCILMAN DUITSMAN MOVED TO APPROVE THE MAY 17TH, 1982 CITY COUNCIL AGENDA AS AMEND- ED. COUNCILMAN SCHULDT SECONDED THE MOTION. THE MOTION PASSED 4-0. 3. Minutes COUNCILMAN ENGSTROM MOVED TO APPROVE THE MINUTES OF THE MAY 3RD, 1982 CITY COUNCIL MEETING. COUNCILMAN DUITSMAN SECONDED THE MOTION. THE MOTION PASSED 4-0. 4. Open Mike Mr. Wally Houle appeared before the City Council requesting the City Council to re- consider the resolution .passed which would prohibit the renewal of a 3.2 beer license for his establishment. Mayor Hinkle indicated that a resolution was passed declar- ing the City of Elk River's policy regarding the issuance of non~intoxicating malt liquor off-sale licenses, and further indicated that the resolution prohibited the sale of non-intoxicating malt liquor off-sale to businesses associated with automo- biles or automobile trade. Councilman Toth indicated that the City Council cannot discriminate against the issuance of 3.2 off-sale beer licenses without a policy. Councilman Toth further indicated that the Food-n-Fuel establishment requested a 3.2 off-sale beer license, but as there are problems in that vicinity, the City Council felt that the addition of the sale of 3.2 beer would not benefit the area. Mr. Wally Houle indicated that the Hagen's grocery store and Ron's grocery store had 3.2 off-sale beer licenses and were not that far from the specific location of the Food~n-Fuel establishment. Councilman Toth indicated that the problems were with young people in and around the pizza place and that the sale of 3.2 beer at the Food-n-Fuel establishment was just too close to'that specific location. Mr. Wally Houle indicated that the resolution was discriminatory and that it was a matter of principle more than anything. The City Administrator indicated that the resolution adopted by the City Council declares the City of Elk River's policy for issuance of non-intoxicating malt liquor licenses and further indicated that City Council's policy is subject to change. Mayor Hinkle indicated that the City Council has expressed a concern of the number of liquor licenses issued in the City of Elk River and the number of non-intoxicating malt liquor licenses, and further indicated that the City Council might consider the adoption of a policy setting the number of licenses that can be issued.
