<br /> <br />~ <br /> <br />REGULAR SEMI-MONTHLY MEETING OF THE <br />ELK RIVER CITY COUNCIL <br />HELD AT THE ELK RIVER PUBLIC LIBRARY <br />MAY 17, 1982 <br /> <br />Members Present: Mayor Hinkle, Councilmembers Schuldt, Engstrom, Toth and Duitsman <br /> <br />Members Absent: None <br /> <br />1. The meeting was called to order at 7:30 p.m. by Mayor Hinkle. <br /> <br />2 . Agenda <br /> <br />Item 7 - Baptists Church Variance, was deleted and Item 12 - Consideration of the <br />Construction of Sidewalks on Irving Avenue, was moved to the Item 7 position. Item <br />5~ - the City Beautification Committee and Item l8E - the City Audit and Liquor In- <br />ventory were added to the May 17th, 1982 City Council Agenda. <br /> <br />COUNCILMAN DUITSMAN MOVED TO APPROVE THE MAY 17TH, 1982 CITY COUNCIL AGENDA AS AMEND- <br />ED. COUNCILMAN SCHULDT SECONDED THE MOTION. THE MOTION PASSED 4-0. <br /> <br />3. Minutes <br /> <br />COUNCILMAN ENGSTROM MOVED TO APPROVE THE MINUTES OF THE MAY 3RD, 1982 CITY COUNCIL <br />MEETING. COUNCILMAN DUITSMAN SECONDED THE MOTION. THE MOTION PASSED 4-0. <br /> <br />4. Open Mike <br /> <br />Mr. Wally Houle appeared before the City Council requesting the City Council to re- <br />consider the resolution .passed which would prohibit the renewal of a 3.2 beer license <br />for his establishment. Mayor Hinkle indicated that a resolution was passed declar- <br />ing the City of Elk River's policy regarding the issuance of non~intoxicating malt <br />liquor off-sale licenses, and further indicated that the resolution prohibited the <br />sale of non-intoxicating malt liquor off-sale to businesses associated with automo- <br />biles or automobile trade. Councilman Toth indicated that the City Council cannot <br />discriminate against the issuance of 3.2 off-sale beer licenses without a policy. <br />Councilman Toth further indicated that the Food-n-Fuel establishment requested a <br />3.2 off-sale beer license, but as there are problems in that vicinity, the City <br />Council felt that the addition of the sale of 3.2 beer would not benefit the area. <br />Mr. Wally Houle indicated that the Hagen's grocery store and Ron's grocery store <br />had 3.2 off-sale beer licenses and were not that far from the specific location of <br />the Food~n-Fuel establishment. Councilman Toth indicated that the problems were <br />with young people in and around the pizza place and that the sale of 3.2 beer at the <br />Food-n-Fuel establishment was just too close to'that specific location. <br /> <br />Mr. Wally Houle indicated that the resolution was discriminatory and that it was a <br />matter of principle more than anything. The City Administrator indicated that the <br />resolution adopted by the City Council declares the City of Elk River's policy for <br />issuance of non-intoxicating malt liquor licenses and further indicated that City <br />Council's policy is subject to change. <br /> <br />Mayor Hinkle indicated that the City Council has expressed a concern of the number of <br />liquor licenses issued in the City of Elk River and the number of non-intoxicating <br />malt liquor licenses, and further indicated that the City Council might consider the <br />adoption of a policy setting the number of licenses that can be issued. <br />
