V 93-03 <br /> APPLICANT <br /> Moyer and Weicht Investment, Inc. , represented by John Weicht, <br /> PO Box 360, Elk River, MN. <br /> REQUESTED ACTION <br /> This request is for an administrative subdivision to divide a <br /> lot containing an existing duplex into two lots with a zero lot <br /> line. The applicants are also requesting variances on lot <br /> width and size for both lots they are proposing to create. <br /> Only the City Council reviews the administrative subdivision <br /> request, therefore, the Planning Commission will only be <br /> • reviewing the variance request. There is a site plan attached <br /> to this memo showing the duplex and garages as well as the <br /> dimensions of the proposed lots . <br /> SITE ZONING <br /> R2/Townhouse District <br /> SURROUNDING ZONING <br /> West - C2/Office District <br /> North and South - R2/Townhouse District <br /> East - Rlc/Single Family Residential <br /> LEGAL DESCRIPTION <br /> Lot 2, Block 3, Burrell ' s Addition. The legal description used <br /> to develop a list of property owners within a 350 foot radius <br /> of the affected property was correct. However, the public <br /> hearing notice in the Star News incorrectly stated Lot 2 , Block <br /> 2, Burrell ' s Addition. MN Statutes states that only one public <br /> hearing needs to be notified. A new ad will be placed in the <br /> paper prior to the Council public hearing on these requests . <br /> Staff feels this application can proceed without delay.
