Variance, Moyer & Weicht Investments Page 2 <br /> April 20, 1993 <br /> • Mr. Weicht constructed a duplex and detached garages on this <br /> lot in 1984 . Both the dwelling units and the garages were <br /> presumably built with two 1 hour fire walls to accomodate a <br /> future lot line as far as building code. <br /> In 1984 , lot standards for an R2 lot were 30 feet in width and <br /> 3,500 square feet in size. Current R2 lot standards are 60 <br /> feet in width and 6,000 square feet in size. <br /> VARIANCE <br /> Staff refers the Planning Commission to Section 900 .40 of the <br /> Elk River Code of Ordinances "Variances" , for the five <br /> standards to consider when reviewing this request. Mr. Weicht <br /> feels he meets the five standards with this request. He states <br /> as his hardship, the fact that an existing structure was built <br /> with a subdivision in mind, at a time when his proposed lot <br /> sizes would have met City code. Further, he feels that the <br /> need for these variances are not a consequence of his own <br /> actions (City code changed) . Lastly, Mr. Weicht feels that <br /> approving the variance would not detrimentally alter the <br /> health, safety, or welfare of the residents of the City or <br /> neighborhood since the structure is already there. <br /> • RECOMMENDATION <br /> Staff recommends the Planning Commission' s approval of this <br /> variance request is contingent upon verification that building <br /> codes for a zero lot line structure are met. <br /> 411 <br />
