ORDINANCE 04 - 014 <br />CITY OF ELK RIVER <br /> <br /> AN ORDINANCE AMENDING THE <br />CITY OF ELK RIVER ZONING MAP TO REZONE CERTAIN PROPERTIES <br />AS DESCRIBED FROM R1C (SINGLE FAMILY RESIDENTIAL) TO PUD <br />(PLANNED UNIT DEVELOPMENT) <br /> <br />CASE NO. ZC 03-07 <br /> <br />The City Council of the City of Elk River does hereby ordain as follows: <br /> <br /> Section 1. The duly adopted Zoning Map of the City of Elk River is hereby <br />amended to rezone the properties described as: <br /> <br /> Outlot A, Brentwood and Lots 3 and 4, Block 3, Ridgewood East 3~d Addition <br /> <br />Section 2. The rezoning is being approved based on the following findings: <br /> <br />1. The proposed rezoning to PUD is consistent the land use designation of Highway <br />Business. <br /> <br />2. The times and conditions have changed to warrant the change in zoning to PUD. A <br />traffic light has been installed at the 197~h Avenue/Highway 169 intersection. There are no <br />other highway commerdal opportunities along the Highway 169 corridor of substantial size <br />to adequately compete with adjacent surrounding communities' commerdal sites. <br /> <br />3. Utilities can be extended to the site without requiring the non-sewered <br />neighborhoods of Ridgewood East 3~ and Brentwood to hook up to the same. <br /> <br />4. The subiect property has good highway visibility and, with a frontage road through <br />the development, could see traffic impacts to the Brentwood neighborhood reduced. The <br />design of the PUD, as well as the vegetation to be preserved and proposed screening, will <br />reduce the impact 'on neighboring residences. <br /> <br /> Section 3.
