ZC 03-07 <br />The City Council of the City of <br />Elk River does hereby ordain as . <br />follows: <br />Section. 1. The duly adopted <br />Zoning Map of the City. of Elk <br />River is hereby amended to rezone <br />the properties described as: <br />Outlot A, Brentwood and Lots 3 <br />and 4, Block 3, Ridgewood East <br />3rd Addition <br />Section 2. The rezoning is being <br />approved based on the following <br />findings: <br />1. The proposed rezoning to PUp <br />is consistent the land use designa- <br />tion of Highway Business. <br />2. The times and conditions have <br />changed to warraJ)t the change in <br />zoning to PUD.. A traffic light has <br />been installed at the I97th <br />Avenue/ Highway 169 intersec- <br />tion. There are no other highway <br />commercial opportunities. along <br />the Highway 169 corridor of sub- <br />stantial size to adequately com- <br />pete with adjacent surrounding <br />communities' commercial sites. <br />3. Utilities can be extended to <br />the site without requiring the nQn" <br />sewered neighbothoods of <br />Rldgewood East 3rd and <br />Brentwood to hook up to the same. <br />4. The subject property has good <br />highway visibility and, with a <br />frontage road through the develop- <br />ment, could see traffic impacts to <br />the Brentwoog: neighborhood <br />reduced. The design of the PUD, as <br />well as the. vegetation to be pre- <br />served, and. proposed screening, <br />will reduce the impact on neigh- <br />boring residences. <br />Section 3.
