Conditional use permit approval was granted in July of 2013 to allow the <br /> garage doors to be located in in the front yard. During that meeting, the location of the dumpster <br /> enclosure was noted on the east side of the building. Since the east side fronts Twin Lakes Road,it is <br /> considered a front yard. The Planning Commission is scheduled to review the building design at their <br /> meeting on August 13, 2013 to review the project for consistency with the design criteria applicable to the <br /> project,based on the most recent plan iteration. <br /> The proposed refuse enclosure is 26'8" by 12'by 8' tall. Dumpsters will be located within,and be <br /> accessed via garage doors from the building, and from the cedar sided gates from the parking lot. The <br /> sides of the structure will be tilt up panels to match the building, all protected by painted concrete <br /> bollards. <br /> A variance may be granted by the Board of Adjustments if it meets the following criteria: <br /> 1. The variance is in harmony with the general moose and intent of the ordinance. <br /> The intent by the prohibition of dumpsters in front yards (and the design guidelines in <br /> general) is to improve the street scape appearance of the city industrial areas. The distance <br /> between the dumpster enclosure and Twin Lakes Road negates any negative impact <br /> associated with a dumpster in a `front'yard. <br /> 2. The variance is consistent with the City of Elk River comprehensive plan. <br /> The variance will not affect future development or plans in the area. <br /> 3. The petitioner proposes to use the properly in a reasonable manner not permitted by the zoning ordinance <br /> The dumpster is located in the least obtriusive area of the project that does not impact the <br /> operations of the site, or the existing gas easement. <br /> P O I E N E A 11 <br /> NATURE <br />
