Zone change, from R -3 to PUD <br />c. Preliminary Plat, with conditions <br />d. Final Plat, with conditions, by resolution <br />e. Easement vacation, by resolution <br />BACKGROUND /DISCUSSION <br />The developer of Kliever Lake Fields 3rd addition is proposing redeveloping the un -built portion of his <br />project into 21 single family, detached townhomes. The Planning Commission reviewed the conditional <br />use permit, the zone change, and the preliminary plat at their meeting on June 11, 2013. Public Hearings <br />were also held that evening. <br />Staff and the Planning Commission recommend approval of the CUP, zone change, and preliminary plat. <br />The preliminary plat approval included some conditions, most of which have been addressed: <br />1. The property shall be rezoned to PUD and a Planned Unit Development Agreement shall be <br />agreed to. <br />2. The development shall meet all applicable fire codes. The fire chief shall verify the location of <br />all fire hydrants, and may require additional hydrants necessary to preserve the health and safety <br />of the residents. <br />3. A common platted lot shall be provided to cover access drives, green areas, and utilities. A <br />blanket drainage and utility easement shall cover this lot. <br />4. A NPDES permit is required prior to final approval of construction drawings. <br />5. Landscaping improvements shall be made as recommended in staffs exhibit A. <br />6. Utility connections shall be made as recommended in staffs utility recommendation, exhibit B <br />7. Utility abandonment plan shall be approved by the city engineer. <br />8. A letter of credit in the amount of 100% of the cost of the landscaping and utility improvements <br />shall be submitted prior to the releasing of the Final Plat for recording. <br />P 0 w E H E D 0 r <br />NaA f RE] <br />
