ARTICLE III, SOLID WASTE FACILITIES* <br />Page 23 of 23 <br />(5) Safe operation. The solid waste processing facility shall be operated in a manner so as to ensure <br />the safest possible operation. The city shall be notified immediately upon the release or spill of <br />hazardous materials at the facility, or of any other dangerous condition at the facility. <br />(6) orderly maintenance. The premises, entrance and exits of all solid waste processing facilities <br />shall be maintained in a clean, neat, and orderly manner at al( times. <br />(7) /Nuisance control. Measures to control rodents, flies, odors, dust, windblown material, and other <br />potential public nuisances shall be adequate to prevent or eliminate any public nuisance. Should the <br />city so prescribe, the licensee, at his own expense, shall engage an exterminator or pest control agent <br />to inspect the solid waste processing facility on at least a monthly basis. A copy of each inspection <br />report shall be sent to the city immediately upon its receipt by the licensee. <br />(8) Inspections. On completion of the solid waste processing facility and prior to initial operation, the <br />city shall be notified to allow personnel of the city to inspect the facility both prior to and during <br />operation. <br />(9) Pertormance testing. Performance testing of the solid waste processing facility may be required by <br />the city council. The city council shall determine the type and frequency of performance testing to be <br />provided in the license for each facility. A report covering results of the performance test in each case <br />shall be prepared by the design engineer of the facility and submitted to the city with a copy of all <br />supporting data. <br />(10) Traffic control. All incoming and outgoing traffic shall be controlled by the licensee in such a <br />manner as to provide orderly and safe ingress and egress and so as not to impede or interfere with <br />general traffic. All roads used for traffic to and from the facility shall be all-weather hard surfaced. <br />(11) Solid waste disposal. All solid waste processed in the solid waste processing facili#y shall be <br />promptly moved from the facility and disposed of in a manner that will prevent nuisances, land pollution, <br />and public health hazards, and as allowed by the city council. The city council may restrict the disposal <br />at any sanitary landfill located within the city of processed or unprocessed solid waste deposited at the <br />solid waste processing facility which has bean generated outside of the county. <br />(12) Washwater. All truck and facility washwa#er shall be captured and retained and not enter the <br />area surface water or groundwater system. No washwater shat! be delivered to the city's sewage <br />treatment plant or introduced into the city's sewer system unless and until specific permission to do so <br />is granted by the city. The city will require testing of washwater before allowing disposal in the city <br />sewer system. <br />(b) The city council, at the time of issuance of the solid waste facility license for the operation of the solid <br />waste processing facility, may modify any of the provisions of this section, or impose additional requirements, if <br />it finds the plan of operation or information submitted with the application or other factors make the imposition <br />of additional requirements or standards necessary to protect and safeguard the public health, safety, and <br />general welfare. <br />(Code 1982, § 604.30(4)) <br />http://library 1.znunicode.com/default-test/DocView/13427/1 /88/91 3/12/2010 <br />
