We will present the comments set forth ul your email yesterday; and the <br />objections set forth in Mr. Perry's letter, to paragraphs 3, 4 (29) and 4 (31) to the Plamung <br />Commission and City Council for their consideration. I asstune you have no other continents or <br />objections to the proposed CUP and License. I appreciate your forwarding the updated legal <br />descriptions. Because the CUP and License regulate only the Landfill itself, and not any <br />property located West of the City Trail, we will use a description of the Landfill property located <br />East of the Trail as Exhibit A. <br />The Planning Coirunission and City Council will not consider amendment of the CUP and <br />license to increase the capacity of the landfill by 1,671,300 cubic yards, because. the necessary <br />application materials to support such an expansion proposal have not been submitted, the public <br />has not been notified of such an expansion proposal, and the City has no information as to <br />whether any further enviro>.unental review of such an expansion proposal is required, and if so, <br />whether it has been completed. <br />If you do wish to withdraw the pending application for renewal of the existing CUP and license, <br />please notify the Cit}r in writing immediately so the public can be notified that there will be no <br />public hearings before the Planning Corrunission and City Council on February 9 aild <br />February 16, 2010. In such event, the existing CUP and license will expire on February 17, <br />2010, and the landfill will be required to cease operations on that date until a new or amended <br />CUP and license are processed and approved as required by Minnesota law. <br />Please let me know if you have any questions.
