Board of Appeal and Equalization Minutes <br />Apri128, 2010 <br />Page 5 <br />Mr. Cullen explained that the Bluffs project has been an ongoing issue since the beginning <br />and he has had difficulty obtaining information he needs. He discussed the minimum <br />assessment agreement that is in place for the Bluffs. <br />MOVED BY COUNCILMEMBER ZERWAS AND SECONDED BY <br />COUNCILMEMBER WESTGAARD TO MAKE NO CHANGE TO THE <br />PARCELS AT CIC #61, THE BLUFFS OF ELK RIVER CONDOS. MOTION <br />CARRIED 5-0. <br />13. William Tyrrell, Parcel Identification Number 75-585-0460 <br />Mr. Tyrrell presented comparables. He requested his value be reduced to $260,000. <br />Mr. Olson reviewed the comparables with Mr. Tyrrell. <br />MOVED BY COUNCILMEMBER MOTIN AND SECONDED BY <br />COUNCILMEMBER WESTGAARD TO ADJUST THE VALUE OF PARCEL 75- <br />585-0460 TO $270,000 WITH REDUCTION COMING FROM THE BUILDING <br />VALUE. MOTION CARRIED 3-2. Councilmembers Gumphrey and Zerwas <br />opposed. <br />14. Chester Borger, Parcel Identification 75-672-0505 <br />Mr. Borger requested his value be reduced to $365,000 based on the sales of neighboring <br />homes. <br />Mr. Olson indicated that one of the neighborhood sales was a short sale and cannot be <br />included in their sales data. He added that Mr. Borger's home is more square footage at <br />1932. Mr. Borger indicated his home is only 1700 square feet. <br />MOVED BY COUNCILMEMBER ZERWAS AND SECONDED BY <br />COUNCILMEMBER GUMPHREY FOR THE APPRAISER TO REMEASURE <br />AND REASSESS PARCEL 75-672-0505 AND REPORT BACK AT THE <br />RECONVENE MEETING. MOTION CARRIED 5-0. <br />15. Paul Heinen and April Westgaard, Parcel Identification Number 75-111-2100 <br />Councilmember Westgaard excused himself from discussion on this item as he is related to <br />appellant. <br />Mr. Heinen and Ms. Westgaard requested their value be reduced. <br />Ms. Henderson explained that there doesn't appear to be 10 contiguous acres in agricultural <br />production on this property; therefore, it would no longer qualify for the agricultural <br />classification and the Green Acres program. <br />Mr. Heinen indicated he has a verbal agreement with a neighbor to cut hay on the property. <br />Ms. Henderson explained that documentation would be necessary if they want to get back <br />the agricultural classification and into the Green Acres program. <br />
