If by generally accepted traffic engineering design standards, the <br />actual phase one traffic results in excess congestion, ERs will be <br />obligated to remove the north access and replace it with a "service" <br />road which will run parallel to Tyler Street north to 173rd Avenue. <br />See attached Exhibit B. <br />Elk River Station will be obligat'ed to provide a letter of credit to <br />guarantee payment of the costs associated with the Possible future <br />extension of the "service road". If it is determined that this <br />"service road" is not necessary, the letter of credit ~will be released <br />after the completion of phase one. <br /> <br />This letter is our attempt to suggest a way to work around and through,our <br />significant difference of opinion as it r,elates to traffic at ERS. As you know, <br />both City and Developer representatives have had numerous and on going <br />discussions about the various parts of this proposal.
